<br />b. It is necessary and desirable to provide for dedication of rights-of-way and easements <br />for capital improvements to support new development at the earliest stage of the <br />development process. <br /> <br />I <br /> <br />c. Requirements for dedication and construction of capital improvements to serve a <br />proposed new development should be attached as conditions of approval of any <br />development application that contains a specific layout of the development. <br /> <br />2. Essential nexus. There is an essential nexus between the demand on public facilities <br />systems created by a new development and the requirement to dedicate rights-of-way and <br />easements and to construct capital improvements to offset such impacts. <br /> <br />3. Mitigation of development impacts, fair share. The City desires to assure both that <br />development impacts are mitigated through contributions of rights-of-way, easements and <br />construction of capital improvements, and that a development project contributes not <br />more than its fair share of such costs. <br /> <br />SECTION 2. Adoption of Land Development Code. The City of San Marcos Land <br />Development Code, a copy of which is attached to this ordinance, is approved and adopted. <br /> <br />SECTION 3. Superseded Ordinances; Limited Continuing Effect. A. The following <br />existing ordinances (the "Previous Development Ordinances") are superseded in their entirety by <br />the provisions of the Land Development Code, except as provided in Section 3.B. below: <br /> <br />1. Article 2, Watershed Protection Program, of Chapter 34, Environment <br />2. Chapter 42, Historic Preservation <br />3. Chapter 50, Manufactured Homes, Mobile Homes, Recreational Vehicles and Parks <br />4. Chapter 98, Floods <br />5. Chapter 94, Development Standards <br />6. Chapter 102, Planning <br />7. Chapter 106, Signs <br />8. Chapter 110, SubdIvIslOns <br />9. Chapter 114, Zomng <br /> <br />I <br /> <br />B. The Previous Development Ordinances shall remalll III effect for the following <br />purposes: <br /> <br />1. Application of the Previous Development Ordinances to development applications that <br />were either <br /> <br />a. Approved prior to the effective date of this ordinance, if the approval was in effect <br />as of the effective date of this ordinance and has not expired; or <br /> <br />b. Duly accepted for filing (as indicated by the issuance of a receipt for the fees I <br />associated with the application) prior to or on the effective date of this ordinance, if the <br />application is approved and has not thereafter expired or been terminated or revoked. <br /> <br />4 <br />
