<br />I <br /> <br />I <br /> <br />I <br /> <br />2. Application of the Previous Development Ordinances to a subsequent development <br />application in series with an approved or filed development application under l.a or l.b <br />above, to the extent the subsequent application is vested under the Previous Development <br />Ordinances by virtue of the provisions of Chapter 245 of the Texas Local Government <br />Code, and does not fall within one or more of the exemptions from vesting contained in <br />that chapter. The nature and extent of vesting and exemptions from vesting shall be <br />determined under Chapter 1, Article 10 of the Land Development Code. <br /> <br />3. Enforcement of zomng-related rules, standards and conditions applicable to and <br />governing uses, structures, and lots lawfully estabhshed and existing under the Previous <br />Development Ordinances that have been rendered non-conforming under the Land <br />Development Code. <br /> <br />4. Enforcement of zoning-related rules, standards and conditions applicable to and <br />governing uses for which specific use permits issued under the Previous Development <br />Ordinances were in effect as of the effective date of this ordinance and have not expired. <br /> <br />5. Enforcement of zoning-related rules, standards and conditions applicable to the zoning <br />districts established in the Previous Development Ordinances, for new uses initiated after <br />the effective date of this ordinance, if the uses are authorized within such districts under <br />the Previous Development Ordinances. This authorization for new uses shall be III effect <br />until six months after the effective date of this ordinance, or until the official zoning map <br />of the City is superseded in its entirety by a new official zoning map with districts that <br />conform to the Land Development Code, whichever is sooner. If a new official zoning <br />map is not adopted during that six month period, then after that time, and until a new <br />official zoning map is adopted, newly initiated uses shall conform to the zoning-related <br />rules, standards and conditions applicable to the zoning districts established in the Land <br />Development Code, in accordance with the Zoning Districts Comparison Table attached <br />to this ordinance. All changes in zoning district boundaries for specific tracts of property <br />after the effective date of this ordinance shall be to a ZOl1lng district contained 111 the Land <br />Development Code. <br /> <br />SECTION 4. Subdivision Master Plans. An approved subdivision master plan subject <br />to Section 3.B.l above may be renewed by the Planning and Zoning Commission under the <br />Previous Development Ordinances using the following criteria: <br /> <br />1. The property owner or developer must have a significant expenditure of funds <br />($100,000 or more) to provide infrastructure to the site. <br /> <br />2. No City Master Plan revisions have been adopted which reflect different policies for <br />development in the area than are shown on the subdivision master plan. <br /> <br />3. The application of superseded impact fee rates to the property covered by the master <br />plan that is not yet platted will not be extended after the first renewal of the master plan <br />approval. <br /> <br />5 <br />
