<br />4. The property owner or developer agrees to incorporate the intent of any new or <br />revised standards in the Land Development Code to a reasonable degree in development <br />applications based on the subdivision master plan that are accepted for filing after the <br />date ofthe renewal. <br /> <br />I <br /> <br />5. Other development has not occurred in the area which fundamentally alters the <br />appropriateness of the type, timing, or intensity of the development proposed in the <br />subdivision master plan. <br /> <br />No renewal of any subdivision master plan under this section shall extend to any period of time <br />after five years from the effective date of this ordinance. <br /> <br />SECTION 5. Technical Manual and Other Technical References: Initial Adoption; <br />Authority of City Staff to Revise. A. The Technical Manual and other technical references <br />referred to in the Land Development Code, including without limitation the City of San Marcos <br />Engineering Design Manual, the Technical Construction Standards and Specifications (TCCS) <br />Manual, the City of Austin Dra111age Criteria Manual, the City of Austin Environmental Criteria <br />Manual, the City of Austin Standard Specifications, and the Institute of Transportation Engineers <br />(lTE) Trip GeneratlOn Manual (together, the "Technical References"), are adopted in the current <br />editions of those references of the effective date of thIS ordinance. <br /> <br />B. The Director of the Planning and Development Services Department and the Director I <br />of the Environment and Engineering Department are authorized to revise, update and clarify the <br />Technical References from time to time. Each of the Technical References adopted or revised <br />shall be documented as to date of adoption or revision, and shall be kept available for public <br />inspection in the offices of the Planning and Development Services Department and the <br />Environment and Engineering Department. <br /> <br />SECTION 6. Fees. The fees shown in the attached Land Development Code Fees table <br />are set in connection with the adoption of the Land Development Code. <br /> <br />SECTION 7. Severability. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the invalid <br />portion. <br /> <br />SECTION 8. Penalty. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction, <br /> <br />SECTION 9. This Ordinance will take effect ten days after the date of its final passage, <br />and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED on first reading on November 22, 2004. <br /> <br />I <br /> <br />6 <br />
