<br />, <br /> <br />4 <br /> <br />~ <br /> <br />Chapter] Development Procedures - Article 2 Authority of Decision-Makers <br /> <br />(2) An application for a Preliminary Subdivision Plat or Preliminary <br />Development Plat; <br /> <br />(3) An application for a Final Subdivision Plat or Final Development Plat, for <br />which no Preliminary Subdivision Plat or Preliminary Development Plat, <br />respectively, has been approved; <br /> <br />(4) An application for a replat; and <br /> <br />(5) An application for a Conditional Use Permit; <br /> <br />(6) Residential Compatibility Site Plans. <br /> <br />(b) Initial Decision-Maker. The Planning and Zoning Commission shall initially decide <br />the following types of quasi-judicial applications, subject to an appeal to the City <br />Council: <br /> <br />(1) An application for a Qualified Watershed Protection Plan; and <br /> <br />(2) An application for a Cluster Development Plan. <br /> <br />Section 1.2.3.4 <br /> <br />Authority for Deciding Administrative Applications <br /> <br />(a) The Planning and Zoning Commission shall finally decide the following types of <br />administrative applications: <br /> <br />(1) An application for a Final Subdivision Plat or Final Development Plat for <br />which a Preliminary Subdivision Plat or Preliminary Development Plat, <br />respectively, has previously been approved; and <br /> <br />(2) An application for an amending plat that has been forwarded by the Director. <br /> <br />Section 1.2.3.5 <br /> <br />Authority for Deciding Appeals and Relief Petitions <br /> <br />(a) Appellate Authority. The Planning and Zoning Commission shall finally decide <br />appeals filed in accordance with Article 10, Relief Procedures, on the following <br />development applications and relief petitions: <br /> <br />(1) A Minor Subdivision Plat that has been forwarded by the Director; <br /> <br />(2) A Site Preparation Permit; and <br /> <br />(3) A Watershed Protection Plan, Phase I or Phase II. <br /> <br />City olSan Marcos, Texas <br /> <br />]-]7 <br /> <br />Land Development Code - Final <br />
