<br />, <br /> <br />tII <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 5 Zoning Procedures <br /> <br />ARTICLE 5: ZONING PROCEDURES <br /> <br />Division 1: Petition for Zoning Map Amendments <br /> <br />Section 1.5.1.1 <br /> <br />Purpose, Applicability and Effect <br /> <br />(a) Purpose. The purpose of a petition for a zoning map amendment is to establish the <br />initial zoning district classification of land, or to authorize a use of land, or in the case <br />of overlay zoning districts, to authorize uses or a set of zoning standards for the land <br />that are not presently authorized under the regulations for the zoning district in which <br />the property is located. <br /> <br />(b) Applicability. Where a property owner seeks to establish an initial zoning district <br />classification for land, or to establish a use of land or through an overlay district to <br />apply standards to a proposed use that are not currently authorized by the zoning <br />district regulations currently in effect, the property owner must submit a petition for a <br />zoning map amendment before seeking approval of any quasi-judicial or <br />administrative development application for such land. The requirements of this <br />division do not apply to land outside of the City limits. The requirements of this <br />division do apply to land annexed to the City upon the effective date of the <br />annexation. <br /> <br />(c) Effect. Enactment of an ordinance approving a petition for a zoning map amendment <br />results in a change in zoning district classification for the property, and the use of the <br />land thereafter is subject to all requirements of the new zoning district. Approval of a <br />petition for a zoning map amendment authorizes the property owner to establish any <br />use authorized in the new zoning district, subject to the standards applicable within <br />the zoning district, upon obtaining approval of all development applications required <br />by this Land Development Code. <br /> <br />Section 1.5.1.2 <br /> <br />Sequence of Approvals <br /> <br />(a) Prior Applications. A petition for a zoning map amendment shall not be approved <br />unless the following petitions, where applicable, have been approved and remain in <br />effect: <br /> <br />(1) Any petition for amendment of the City's Master Plan upon which the petition <br />for zoning map amendment is dependent, provided that the Master Plan <br />amendment and the zoning map amendment may be processed concurrently as <br />long as the recommendation and decision on the Master Plan amendment is <br />made first; and <br /> <br />City of San Marcos, Texas <br /> <br />1-49 <br /> <br />Land Development Code - Final <br />
