-4- Sec. 4.05. Assistant to the city council. "The City Council may appoint an assistant to perform such services for the City Counc il as it shall request and which are not inconsistent with this Charter. II Item 8: Sec. 5.05. Election by majority. "At any regular or special municipal election the candidates in each place on the ballot who shall have received the majority of votes cast in such election for such place shall be declared elected. In the event no candidate for a designated place on the city council receives a majority of the votes cast for that place in the regular or special election, a runoff election shall be held between the two (2) candidates who received the greatest number of votes for such place. Such runoff election shall be held on the second Saturday following the preceding regular or special election." Change the last sentence to read as follows: "Such runoff election shall be held exactly four (4) weeks following the preceding regular or special election. II ITEM 9: Amend Section 5.08 of the City Charter of the City of San Marcos, Texas, to cause the Oath of Office to conform to State law, as follows: Sec. 5.08. Oath of Office. "Ever:y officer of the City shall, before entering upon the duties of the office take and subscribe to the following oath or affirmation to be filed and kept in the office of the City Secretar:y: II, , do solemnly swear (or affirm) , that I will faithfully execute the duties of the office of the , of the City of San Marcos, State of Texas, and will to the best of II¥ ability preserve, protect and defend the constitution and laws of the United Sta tes and of this sta te and the Charter and ordinances of this City; and I furthermore solemnly swear (or affirm), that I have not directly nor indirectly paid, offered, or promised to pay, contributed nor promised to contribute any money or valuable thing, or promised any public office or employment, as a reward for the giving or withholding a vote at the election at which I was elected, or if the office is one of appointment, to secure II¥ appointrænt.
