<br /> -4- <br />Sec. 4.05. Assistant to the city council. <br />"The City Council may appoint an assistant to perform such services <br />for the City Counc il as it shall request and which are not <br />inconsistent with this Charter. II <br />Item 8: <br />Sec. 5.05. Election by majority. <br />"At any regular or special municipal election the candidates in each <br />place on the ballot who shall have received the majority of votes cast <br />in such election for such place shall be declared elected. In the <br />event no candidate for a designated place on the city council receives <br />a majority of the votes cast for that place in the regular or special <br />election, a runoff election shall be held between the two (2) <br />candidates who received the greatest number of votes for such place. <br />Such runoff election shall be held on the second Saturday following the <br />preceding regular or special election." <br />Change the last sentence to read as follows: <br />"Such runoff election shall be held exactly four (4) weeks following <br />the preceding regular or special election. II <br />ITEM 9: Amend Section 5.08 of the City Charter of the City of San <br /> Marcos, Texas, to cause the Oath of Office to conform to State <br /> law, as follows: <br />Sec. 5.08. Oath of Office. <br />"Ever:y officer of the City shall, before entering upon the duties of <br />the office take and subscribe to the following oath or affirmation <br />to be filed and kept in the office of the City Secretar:y: <br />II, , do solemnly swear (or affirm) , that I will <br />faithfully execute the duties of the office of the , of the <br />City of San Marcos, State of Texas, and will to the best of II¥ ability <br />preserve, protect and defend the constitution and laws of the United <br />Sta tes and of this sta te and the Charter and ordinances of this City; <br />and I furthermore solemnly swear (or affirm), that I have not directly <br />nor indirectly paid, offered, or promised to pay, contributed nor <br />promised to contribute any money or valuable thing, or promised any <br />public office or employment, as a reward for the giving or withholding <br />a vote at the election at which I was elected, or if the office is <br />one of appointment, to secure II¥ appointrænt. J" <br />
