<br /> -6- <br />ITEM 12: <br />Sec. 6.07. Fb\A~r of recall. <br />"The people of the city reserve the power to recall any elected <br />officer of the City of San ~1arcos and may exercise such poær by filing <br />with the city secretary a petition signed by at least ten per cent <br />(10%) of the qualified voters voting in the last regular city election <br />or two hundred fifty (?50) whichever is the greater demanding the <br />removal of such elected officer. The petition shall be signed and <br />verified in the manner required for an initiative petition." <br />r::e Ie te the last sen tence of Sec. 6.07 and substitute for it the <br />following: "The petition required for the recall of any elected <br />official of the City of San Marcos shall be provided only by the <br />City Secretary and shall include spaces for each person to sign their <br />n a:rœ and provide their n a:rœ in prin ted forro., their residence <br />address, and their voter registration number. No signatures shall be <br />counted where there is reason to believe it is not the actual <br />signature of the proported signer or that it is a duplication either of <br />name or handwriting used in any other signature on the <br />petition, and no signature shall be counted unless the residence <br />address and voter registration number of the signer is shown, or <br />unless it is signed exactly as the name of the voter appears on the <br />official copy of the current list of exempt voters. Before <br />signatures on any recall petition form may be counted, one of the <br />signers of such petition paper, a qualified voter in the City of San <br />Marcos, shall make oath before the Ci ty Secretary, that the <br />statemants made therein are true, that each signature to the <br />paper appended is the genuine signature of the person whose <br />nama purports to be signed thereto, and that such signatures <br />were placed thereon in the affiant's presence. Any recall <br />petition form supplied by the City Secretary shall be valid for <br />thirty (30) days from the date of its issuance and the expiration <br />date and time shall be no ted on the petition form by the City <br />Secretary at the time of its issuance. All such forms must be <br />returned to the City Secretary before their respective expiration <br />dates in order to be eligible to be verified and certified by the City <br />Secretary. The City Secretary shall have forty five (45) days <br />from the receipt of any recall petition or petitions to verify and <br />certify to their sufficiency." <br />r::elete the following phrase from Sec. 6.07: <br />"voting in the last regular city election or two hundred fifty (250) <br />whichever is the greater". <br />ITEM 13: <br />Sec. 7.06.
