<br /> -7- <br /> not less than one hundred twenty (120) days prior to the <br /> beginning of the fiscal year, a list of recommended changes, if <br /> any, in the master plan;" <br />After the word "submit" add the words "at least" before the word <br />"annually". <br />ITEM 14: <br />Sec. 7.08. 'The master plan. <br />"The master plan for the physical development of the City of San <br />Marcos shall contain the recommendations of the planning comITcission for <br />growth, development and beautification of the city. The council may <br />amend the master plan after at least one public hearing on the proposed <br />action; provided, however, that it shall take a three-fourths (3/4) <br />vote of all the members of the legislative body of the City of San <br />Marcos to overrule a recommendation of the planning commission <br />pertaining to a proposed amendment of the master plan. The counc il <br />shall not act on any amendment affecting the master plan <br />unless and until a recorm:œndation on said amendment is <br />received frcrn the planning commission." <br />rBlete everything in the second sentence from the semicolon to the end <br />of that sentence in order to eliminate a problem created when the City <br />Counc il does not agree with the Planning Oammission's recommendation <br />but does not have the three-fourths (3/4) vote necessary to override <br />it. This has resulted in some land use decisions being put in a <br />sort of purgatory. This could cause us some legal problems in the <br />future, if it has not already done so. <br />ITEM 15: Þmend Section 8.17 of the City Charter of the City of San <br /> ~.1arcos, Texas, to provide for certification of sufficient <br /> funds for an expenditure by the Finance Director and to give <br /> the City Manager authority to approve contracts for all <br /> budgeted items not exceeding 55,000, and to clarify the <br /> City's rights in the bidding process by changing the Section <br /> as indicated by the words underlined, as follows: <br />Sec. 8.17 Purchase procedure. <br />"All purchases made and contracts executed by the City shall <br />be pursuant to a requisition from the head of the administrative <br />unit whose appropriation will be charged, and no contract or <br />order shall be binding upon the City unless and <br />until the Finance Director certifies that there is to <br />the credit of such administrative unit a sufficient <br />unencumbered appropriation and an allotrænt balance to pay for <br />these supplies, materials, equiprœnt, or contractual services, for <br />wh ich the contract or order is to be issued. B=fore the City makes <br />any purchase or contract for supplies, ma terials , <br />equipment, or contractual services, opportunity shall be given <br />
