<br />MARCOS, TEXAS AMENDING THE FUTURE LAND USE PLAN (MAP)
<br />OF THE MASTER PLAN OF SAID CITY FROM HIGH DENSITY
<br />RESIDENTIAL TO COMMERCIAL; AMENDING SECTION 3 OF THAT
<br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION
<br />AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE
<br />13, 1984, (VOL.66) BY CHANGING THE ZONING OF A 1.78
<br />ACRE TRACT FROM "PD" (PRE-DEVELOPMENT DISTRICT) TO "c"
<br />(COMMERCIAL DISTRICT), A 1.02 ACRE TRACT FROM "R-l"
<br />(SINGLE-FAMILY DWELLING DISTRICT) TO lIC" (COMMERCIAL
<br />DISTRICT), A 10.41 ACRE TRACT FROM "PD" (PRE-DEVELOPMENT
<br />DISTRICT) TO "MF-3" (MULTI-FAMILY DISTRICT), A 2.50
<br />ACRE TRACT AND AN 0.32 ACRE TRACT FROM "c" (COMMERCIAL
<br />DISTRICT) TO "MF-3" (MULTI-FMAILY IDSTRICT) , ALL OF SAID
<br />TRACTS FOR WHICH THE ABOVE-REFERENCED LAND USE AMENDMENT
<br />AND ZONING AMENDMENTS ARE PROPOSED BEING LAND AREA IN
<br />THE J.M.VERAMENDI LEAGUE SURVEY NO.2, CITY OF SAN MAR-
<br />COS, HAYS COUNTY, TEXAS, AND BEING PORTIONS OF THAT 22.4944
<br />ACRE TRACT CONVEYED FROM ROBERT F. GAERTNER TO SB&K JOINT
<br />VENTURE BY DEED DATED APRIL 22, 1985 AS RECORDED IN VOL-
<br />UME 514, PAGE 894 OF THE HA~B COUNTY REAL PROPERTY RE-
<br />CORDS, AND SAID TRACTS BEING LOCATED ON THE EAST SIDE
<br />OF IH-35 NORTH AND SOUTH OF UHLAND ROAD; AND DECLARING
<br />AN EFFECTIVE DATE.

<br />Mayor Craddock declared the public hearing open and asked if anyone
<br />wished to speak in favor of the Ordinance, and no one did. Mayor Craddock

<br />Mayor Craddock declared the public hearing closed. Ms. Kissler moved
<br />for approval of the Ordinance on first reading, and Mr. Brown seconded
<br />the motion which passed unanimously.

<br />Mayor Craddock introduced for consideration a public hearing and adoption
<br />of a Resolution, the caption which was read as follows:

<br />CONTAINING 1.1564 ACRES (50371 SQUARE FEET) OUT OF THE
<br />J.M. VERAMENDI LEAGUE NO.1, HAYS COUNTY, TEXAS, AND
<br />LYING WITHIN THAT APPROXIMATE FIFTY ACRE TRACT CONVEYED
<br />BY WILL G. BARBER TO ARNULFO LUCIO BY THAT DEED DATED
<br />17 OCTOBER 1905, IN VOLUME 48, PAGES 548-550 OF THE
<br />DEED RECORDS OF SAID COUNTY, SAID FIFTY ACRE TRACT BEING
<br />THAT SAME TRACT CONVEYED BY MANUEL LUCIO, EPIFANIA LUCIO,
<br />JOSE LUCIO, MONICA LUCIO, ISADORA RODRIGUEZ, AND DIMAS
<br />RODRIGUEZ TO MRS. GUADALUPE LUCIO BY THAT DEED DATED
<br />14 NOVEMBER 1936, FILED 25 NOVEMBER 1936, AND RECORDED
<br />ON 1 DECEMBER 1936 IN VOLUME 112, PAGES 330-332 OF THE
<br />SAID DEED RECORDS. THIS 1.1564 PARCEL IS IDENTICAL TO
<br />THAT TRACT CONVEYED BY MRS. GUADALUPE LUCIO TO LUCIANO
<br />J. LUCIO AND JANIE LUCIO BY THAT DEED DATED 15 JULY 1953,
<br />FILED 31 OCTOBER 1953, AND RECORDED ON 2 NOVEMBER 1953
<br />IN VOLUME 157, PAGES 543-544 OF THE DEED RECORDS OF SAID
<br />COUNTY, AND IS ALSO IDENTICAL TO THAT TRACT CONVEYED BY
<br />MARGARITA LUCIO TO MRS. JANIS LUCIO BY THAT DEED DATED 8
<br />APRIL 1971, FILED 14 APRIL 1971, AND RECORDED ON 15 APRIL
<br />1971 IN VOLUME 242, PAGES 734-735 OF THE DEED RECORDS OF
<br />SAID COUNTY, SAID 1.1564 ACRE TRACT BEING LOCATED ON THE
<br />SOUTHEAST SIDE OF THE INTERSECITON OF WEST SAN ANTONIO
<br />AND WEST HOPKINS STREET IN SAID CITY, FROM LOW DENSITY
<br />RESIDENTIAL AND PERMANENT OPEN SPACE AND/OR FLOODPLAIN
<br />TO COMMERCIAL; AND DECLARING AN EFFECTIVE DATE.
