<br /> ARTICLE 5 <br /> COMPENSATION TO ENGINEER <br /> The Owner agrees to pay the Engineer for all services <br /> rendered under this Agreement in accordance with the <br /> following: <br /> 5.1 MAIN INTERCEPTOR <br /> 5.1.1 For Section 1.1.1 Preliminary Study and Recommendation <br /> Phase: The Engineer shall be compensated in accordance with the <br /> Schedule of Charges as shown in Exhibit A which is attached hereto <br /> and incorporated herein for all purposes. The total amount shall <br /> not exceed Twenty Thousand Five Hundred Dollars ($20,500.00) <br /> without prior written consent of Owner. <br /> 5.1.2 For Section 1.1.2 Notification of Desired Action: <br /> Depending on the Option selected by the Owner, the Engineer shall <br /> receive the following compensation: <br /> A. Option I - No Corrective Action: No additional <br /> compensation except as subsequently quoted and agreed to by Owner <br /> for services performed in accordance with Section 1.5, Additional <br /> Services, of this Agreement. <br /> B. Option II - Corrective Action <br /> 1. Preliminary Phase and Design Phase: For services <br /> rendered as described under Section 1.1.2(B), Option II, 1- <br /> Preliminary Phase and 2. Design Phase, the Engineer shall be <br /> compensated for this work on the standard cost times multiplier <br /> basis as shown in Exhibit A, Schedule of Charges. Said fee shall <br /> not exceed Forty-Four Thousand Nine Hundred Dollars ($44,900.00) <br /> if services rendered are for a Separate Project; or if services <br /> rendered are for a Combined Project, Engineer shall be compensated <br /> as shown under Section 5.2.1, Preliminary Phase and Design Phase <br /> for Combined Project. <br /> For purposes of this Agreement, a Separate Project means <br /> that Plans and other Contract Documents for the Main Interceptor <br /> Project will be prepared separately from those Plans and other <br /> Contract Documents prepared for the University Interceptor Project <br /> resulting in two sets of the same. A combined Project means that <br /> Plans and other Contract Documents for both the Main Interceptor <br /> -17- <br />
