ARTICLE 5 COMPENSATION TO ENGINEER The Owner agrees to pay the Engineer for all services rendered under this Agreement in accordance with the following: 5.1 MAIN INTERCEPTOR 5.1.1 For Section 1.1.1 Preliminary Study and Recommendation Phase: The Engineer shall be compensated in accordance with the Schedule of Charges as shown in Exhibit A which is attached hereto and incorporated herein for all purposes. The total amount shall not exceed Twenty Thousand Five Hundred Dollars ($20,500.00) without prior written consent of Owner. 5.1.2 For Section 1.1.2 Notification of Desired Action: Depending on the Option selected by the Owner, the Engineer shall receive the following compensation: A. Option I - No Corrective Action: No additional compensation except as subsequently quoted and agreed to by Owner for services performed in accordance with Section 1.5, Additional Services, of this Agreement. B. Option II - Corrective Action 1. Preliminary Phase and Design Phase: For services rendered as described under Section 1.1.2(B), Option II, 1- Preliminary Phase and 2. Design Phase, the Engineer shall be compensated for this work on the standard cost times multiplier basis as shown in Exhibit A, Schedule of Charges. Said fee shall not exceed Forty-Four Thousand Nine Hundred Dollars ($44,900.00) if services rendered are for a Separate Project; or if services rendered are for a Combined Project, Engineer shall be compensated as shown under Section 5.2.1, Preliminary Phase and Design Phase for Combined Project. For purposes of this Agreement, a Separate Project means that Plans and other Contract Documents for the Main Interceptor Project will be prepared separately from those Plans and other Contract Documents prepared for the University Interceptor Project resulting in two sets of the same.
