E. Prepare and issue Addenda related to errors or clarifications. The Engineer shall pay and be reimbursed for all expenses incurred for reproduction and distribution of Invitation For Bids, Plans and other Contract Documents, and the Engineer shall retain the non-refundable payment made by prospective bidders for copies of same. The Engineer shall obtain written authority from the Owner for the amount of the non-refundable payment which will be determined by the Owner based on the actual reasonable cost to Engineer for the reproduction and distribution of the materials. 12.4 SUBSURFACE INVESTIGATIONS AND LABORATORY TESTS 12.4.1 The Engineer will identify for Owner all subsurface investigations, including borings, test pits, soil investigations, soil resistivity surveys, and other subsurface explorations necessary for accurate design of the project(s) and request the Owner to have the same performed; however, the making of such investigations and the interpretations of data and reports by special consultants are not a part of the services to be rendered by the Engineer, and the cost therefor shall be paid by the Owner and the Owner shall be solely responsible for obtaining the services of such special consultants. The Engineer shall be responsible for monitoring and reviewing the work of testing laboratories and inspection bureaus required for the testing or inspection of materials, etc., for the project(s} only at the request of Owner. 12.5 OTHER DUTIES AS SET FORTH IN CONTRACT DOCUMENTS 12.5.1 Engineer shall have such other duties and responsibilities and limitations of authority as agreed to by Engineer and as are set forth in the Contract Documents which are made a part hereof and incorporated herein by reference as if copied herein verbatim. However, in the event of conflict, dispute, or discrepancy between the provisions of this Agreement and the Contract Documents, the more restrictive and/or burdensome provisions shall govern and control. -28-
