<br /> -10- <br /> SECTION 7. Responsibilities of Municipal <br /> Departments <br /> A. Any written agreement, purchase order or <br /> instrument whereby the City of San Marcos is <br /> committed to the expenditure of funds in <br /> return for work, labor, services, supplies, <br /> equipment, materials or any combination of the <br /> foregoing, shall not be entered into unless <br /> such agreement, purchase order or instrument <br /> contains provisions requiring that equipment <br /> and activities which are subject to the <br /> provisions of this code will be operated, <br /> constructed, conducted or manufactured without <br /> causing violation of this chapter. <br /> B. All departments and agencies of the City of <br /> San Marcos, Texas, shall, to the fullest <br /> extent consistent with other ordinances, carry <br /> out their programs in such a manner as to <br /> further the policies of this ordinance in <br /> cooperation with its enforcement. <br /> C. All departments whose duty it is to revise and <br /> approve new projects or changes to existing <br /> projects that result or may result in the <br /> production of excessive noise shall consult <br /> with the City Manager prior to any such <br /> approval. <br /> SECTION 8. Public and Private Project Rev iew <br />All public and private projects shall be subject to a review <br />process by the City Manager in order to determine if such <br />projects are likely to cause noise or vibration in violation <br />of this Ordinance. The City Manager shall be authorized to <br />make or require any investigations or studies which in his <br />opinion are necessary to determine if compliance with this <br />Ordinance can be achieved. The City Manager shall also have <br />the authority to require noise attenuation measures in <br />accordance with the findings of said investigations or <br />studies for the purpose of determining compliance with this <br />Ordinance. <br /> SECTION 9. Airport and Aircraft Operations <br />All airport and/or aircraft operations within the corporate <br />limits of the City of San Marcos, Texas, shall be conducted <br />in all respects in conformity with or pursuant to applicable <br />laws and regulations of the United States Environmental <br />Protection Agency and the United States Department of <br />Transportation Federal Aviation Administration. <br /> SECTION 10. Noises Permitted - Emergencies <br />Noise created in the performance of emergency work for their <br />immediate safety, health or welfare of the community or <br />individuals of the community or to restore property to a safe <br />condition following a public calamity shall not be subject to <br />the provisions of the San Marcos Noise Ordinance. Nothing in <br />this section shall be construed to permit law enforcement, <br />ambulance, fire or other emergency personnel to make <br />excessive noise in the performance of their duties when such <br />noise is clearly unnecessary. <br /> SECTION 11. Noises Permitted - Undue Hardship <br />Applications for a permit for relief from the sound pressure <br />levels designated in this Ordinance or regulations set by <br />this Ordinance on the basis of undue hardship may be made to <br />the City Manager or his duly authorized representative.
