<br /> -9- <br />D. Notwithstanding the provisions of Section 5 A, <br /> Band C no person shall be cited fora violation <br />of any of those provisions unless: <br /> 1. the person has received a verbal warning <br /> from a police officer that a violation <br /> has occurred, and <br /> 2. the violation has not been corrected for <br /> a period in excess of 5 minutes or the <br /> same violation re-occurred after 5 <br /> minutes but not later than 4 hours from <br /> the time of the warning. <br />SECTION 6. Motor Vehicle Noise <br />A. No person shall drive or move or permit to be <br /> driven or moved a motor vehicle or combination <br /> of motor vehicles at any time on a public <br /> right-of-way under any conditions of grade, <br /> load, acceleration or deceleration in such a <br /> manner as to exceed the sound limits set forth <br /> in the following table for the appropriate <br /> category of motor vehicle. Measurement shall <br /> be made at a distance of twenty-five feet <br /> ( 25 ') or 7.5 meters for Class 1 and Class 2 <br /> vehicles measured from the near side of the <br /> nearest lane being monitored at a height of at <br /> least four (4) feet or 1.2 meters above the <br /> immediate surface. <br /> Motor Vehicle and Motorcycle Sound Limits <br /> Vehicle Sound Pressure <br /> Class Level, dBA <br />Class 1. Any motor vehicle, Speed Speed <br /> motorcycle, or Limit Limit <br /> combination of 35MPH over <br /> vehicles with a or less 35MPH <br /> GVWR or GCWR less <br /> than 10,000 Ibs. 82 87 <br />Class 2. Any motor vehicle <br /> with a GmvR or GCWR <br /> of 10,000 Ibs. or more 87 92 <br />B. This section applies to the total noise from a <br /> vehicle or combination of vehicles and shall <br /> not be construed as limiting or precluding the <br /> enforcement of any provisions of the Texas <br /> Uniform Act Regulating Traffic on Highways, <br /> Article 6701d, Texas Revised Civil Statutes, <br /> relating to motor vehicle mufflers or exhaust <br /> systems. <br />C. It is unlawful for any person to operate a <br /> motor vehicle in such a manner as to cause or <br /> allow to be emitted squealing, screeching or <br /> other such sound from the tires in contact <br /> with the ground because of rapid acceleration <br /> or excessive speed around corners or other <br /> such reason, provided that sound resulting <br /> from emergency braking to avoid imminent <br /> danger shall be exempt from this section. <br />D. No person shall operate or permit to be <br /> operated any motorized vehicle off a public <br /> right-of-way in such manner as to exceed the <br /> sound levels as listed in Section 5 at the <br /> receiving property boundary. <br />
