Yelling, Shouting, Singing - <br /> Yelling, shouting, or singing on <br /> the public streets between the <br /> hours of 10:00 p.m. and 07:00 a.m. <br /> the following day so as to annoy or <br /> disturb the peace, comfort and <br /> repose of neighboring persons of <br /> ordinary sensibilities. <br /> 11. vibration - Using or causing the <br /> use of any device that creates <br /> vibration which is above the <br /> perception threshold of any <br /> individual at or beyond the <br /> property boundary of the source if <br /> on private property or at 50 feet <br /> from the source if on a public <br /> space or public right-of-way. <br />SECTION 4. Use Districts - Maximum Permissible <br /> Sound Levels - Correction For <br /> Duration of Sound <br />A. It is a violation of the San Marcos Noise <br /> Ordinance for any person to operate or permit <br /> to be operated any stationary source of sound <br /> within the corporate limits of the City of San <br /> Marcos, Texas, in such a manner as to create a <br /> ninetieth percentile sound pressure level <br /> (LtO) of any measurement period, which shall <br /> no be less than 5 minutes, which exceeds the <br /> limits set forth for the following receiving <br /> zones when measured at the boundary or at any <br /> point within the receiving property affected <br /> by the noise: <br /> Use 10:00 p.m.- 07:00 a.m. - <br /> District 07:00 a.m. 10:00 p.m. <br /> Residential 50 dBA 55 dBA <br /> Commercial 55 dBA 60 dBA <br /> Industrial/ 70 dBA 75 dBA <br /> Agricultural/ <br /> Open Space <br /> When a noise source can be identified and its <br /> noise measured in more than one land use <br /> category, the limits of the more restrictive <br /> use shall apply at the boundary and within the <br /> most restrictive land use property. <br />B. It is a violation of the San Marcos Noise <br /> Ordinance for any person to operate or permit <br /> to be operated any stationary source of sound <br /> within the corporate limits of the City of San <br /> Marcos, Texas, which creates a tenth <br /> percentile sound pressure level (Ll~) of 10 <br /> dBA greater than the levels set forth or the <br /> receiving use districts in subdivision A of <br /> this section for any measurement period. Such <br /> measurement period shall not be less than 5 <br /> minutes. <br />C. Notwithstanding the provisions of subsection B <br /> of this section, it is a violation of the San <br /> Marcos Noise Ordinance for any person to <br /> operate or permit to be operated any <br /> stationary source of sound ,vithin the <br /> corporate limits of the City of San Marcos, <br /> Texas, which creates a tenth percentile sound <br /> pressure level (LðO) greater than 15 dBA above <br /> the ambient so un pressure level (Lg ) of any <br /> measurement period. Such measuremen~ period <br /> shall not be less than 5 minutes. <br />
