Yelling, Shouting, Singing - Yelling, shouting, or singing on the public streets between the hours of 10:00 p.m. and 07:00 a.m. the following day so as to annoy or disturb the peace, comfort and repose of neighboring persons of ordinary sensibilities. 11. vibration - Using or causing the use of any device that creates vibration which is above the perception threshold of any individual at or beyond the property boundary of the source if on private property or at 50 feet from the source if on a public space or public right-of-way. SECTION 4. Use Districts - Maximum Permissible Sound Levels - Correction For Duration of Sound A. It is a violation of the San Marcos Noise Ordinance for any person to operate or permit to be operated any stationary source of sound within the corporate limits of the City of San Marcos, Texas, in such a manner as to create a ninetieth percentile sound pressure level (LtO) of any measurement period, which shall no be less than 5 minutes, which exceeds the limits set forth for the following receiving zones when measured at the boundary or at any point within the receiving property affected by the noise: Use 10:00 p.m.- 07:00 a.m. - District 07:00 a.m. 10:00 p.m. Residential 50 dBA 55 dBA Commercial 55 dBA 60 dBA Industrial/ 70 dBA 75 dBA Agricultural/ Open Space When a noise source can be identified and its noise measured in more than one land use category, the limits of the more restrictive use shall apply at the boundary and within the most restrictive land use property. B. It is a violation of the San Marcos Noise Ordinance for any person to operate or permit to be operated any stationary source of sound within the corporate limits of the City of San Marcos, Texas, which creates a tenth percentile sound pressure level (Ll~) of 10 dBA greater than the levels set forth or the receiving use districts in subdivision A of this section for any measurement period. Such measurement period shall not be less than 5 minutes. C. Notwithstanding the provisions of subsection B of this section, it is a violation of the San Marcos Noise Ordinance for any person to operate or permit to be operated any stationary source of sound ,vithin the corporate limits of the City of San Marcos, Texas, which creates a tenth percentile sound pressure level (LðO) greater than 15 dBA above the ambient so un pressure level (Lg ) of any measurement period. Such measuremen~ period shall not be less than 5 minutes.
