<br /> 15 <br />Regular Meeting May 12, 1986 Page 7 <br />Mayor Younger introduced for consideration a public hearing and ap- <br />proval of an Ordinance on first reading, the caption which was read <br />as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, N1ENDING THE FUTURE LAND USE PLAN <br />(MAP) OF THE MASTER PLAN OF SAID CITY ADOPTED ON <br />MAY 9, 1983 FOR 199.62 ACRES, MORE OR LESS, OF LAND <br />AREA IN THE J. M. VERAMENDI LEAGUE NO. 1, A-17, AND <br />THE JAMES CURTIS SURVEY, A-3, IN SAN MARCOS, HAYS <br />COUNTY, TEXAS; AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, <br />1984 (VOL. 66) BY CHANGING THE ZONING OF 57.67 ACRES, <br />MORE OR LESS, OUT OF SAID 199.62 ACRE TRACT, FROM "PD" <br />(PRE-DEVELOPMENT DISTRICT) TO "PDD" (PLANNED DEVELOP- <br />MENT DISTRICT); APPROVING A PDD DEVELOPMENT PLAN FOR <br />SAID 57.67 ACRE TRACT: APPROVING A SITE PLAN FOR SAID <br />57.67 ACRE TRACT IN ACCORDANCE WITH CHAPTER 36, SAN <br />MARCOS RIVER CORRIDOR, OF THE CODE OF ORDINANCES OF <br />SAID CITY: AND DECLARING AN EFFECTIVE DATE. <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak in favor or in opposition to this request. No one did, so Mayor <br />Younger closed the public hearing. At the request of the owner of the <br />property, Ms. Kissler moved to table consideration of this matter and <br />Mr. Brown seconded the motion, which passed unanimously. <br />Mayor Younger introduced for consideration a public hearing and approv- <br />al of an Ordinance on first reading, the caption which was read as fol- <br />lows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE SUBDIVISION ORDINANCE OF <br />THE CITY OF SAN MARCOS BY TRANSFERRING CERTAIN SECTIONS <br />PERTAINING TO DEVELOPMENT OVER THE EDWARDS AQUIFER RE- <br />CHARGE ZONE FROM ARTICLE VI, SECTION F AND SECTION H, TO <br />A NEW ARTICLE VI, SECTION M AND PROVIDING IN THE NEW <br />SECTION M FOR WATER QUALITY CONTROLS IN CRITICAL WATER <br />QUALITY ZONES, PROVIDING FOR INSPECTIONS, PROVIDING FOR <br />PLAN APPROVAL AND DECLARING AN EFFECTIVE DATE. <br />Mayor Younger opened the public hearing and asked if anyone wished to <br />speak for or in opposition to the amendment. Mr. Robbins stated the <br />amendment was presented to protect water quality and protect the <br />water supply and character of the hill country. Shirley Wickersham <br />stated she had served on the Citizens Advisory Committee, and that <br />she felt this amendment was a Staff oriented Ordinance with no techni- <br />cal expertise on the Committee which assisted in drafting it. John <br />McCrocklin wanted to know who wrote the section on filtering of con- <br />taminants and felt the words in Section 3.g.(3) "total dissolved solids" <br />should be removed. Mr. Robbins stated the language of the Ordinance <br />largely comes from Austin's Ordinance and was modified through the San <br />Marcos River Corridor Ordinance. Mr. McCrocklin stated he felt the <br />language in our Ordinance basically follows Austin's Ordinance and <br />pointed out that more times than not, Austin's Ordinance fails, and <br />that the items we list need to be reasonable. Mr. McCrocklin asked <br />how we determined a need for 64-acre basins in Section 3.4.a. and Mr. <br />Robbins responded there was no technical reason, that it was simply <br />designed after the Barton Creek Ordinance of 1980. Mr. McCrocklin <br />pointed out Austin's Ordinance works a hardship on development, as <br />would our Ordinance even though it is not as stringent as Austin's. <br />
