<br /> AND TEMPORARY CONSTRUCTION EASEMENT
<br /> THE COUNTY OF HAYS §
<br /> KNOW ALL PERSONS BY THESE PRESENTS:
<br /> That We, Tom G. Oliver, Jr. and Gene Phillips, as Trustees of
<br /> the Paul J. Rogers Trust and the Penelope Field Rogers Trust; J.
<br /> Lloyd Moore, Jr. and John F. Baugh, as Managing Venturer and
<br /> Venturer, respectively, of the Baugh/Moore I Joint Venture, a
<br /> Texas partnership; J. Lloyd Moore, Jr., Barbara Baugh Morrison and
<br /> Robert Lee Morrison, as Managing Venturer and Venturers,
<br /> respectively, of the Morrison/Moore I Joint Venture, a Texas
<br /> partnership; and J. Lloyd Moore, Jr., Barbara Baugh Morrison and
<br /> Robert Lee Morrison, as Managing Venturer and Venturers,
<br /> respectively, of the Morrison/Moore II Joint Venture, a Texas
<br /> partnership; hereinafter referred to as Grantors, for the sum of
<br /> TEN DOLLARS ($10.00) in hand paid, and other good and valuable
<br /> consideration, the receipt and sufficiency of which are hereby
<br /> acknowledged, do hereby GRANT, SELL AND CONVEY in perpetuity unto
<br /> the CITY OF SAN MARCOS, TEXAS, a municipal corporation of Hays
<br /> County, organized and existing by and under the laws of the State
<br /> of Texas, with its office at 630 East Hopkins, San Marcos, Texas,
<br /> 78666, its successors and assigns, hereinafter referred to as
<br /> Grantee, a sewerline easement ten (10) feet in width on, over and
<br /> across, real property located in San Marcos, Hays County, Texas,
<br /> the said easement being over a portion of that 211.4 acre tract of
<br /> land conveyed to Paul J. Rogers by James L. Moore by deed dated
<br /> September 15, 1951 and recorded in Volume 151, Page 34, Hays
<br /> County Deed Records, and being over a portion of that 52.0 acre
<br /> tract of land conveyed to Paul J. Rogers by A. B. Rogers by deed
<br /> dated August 5, 1949 and recorded in Volume 144, Page 330, Hays
<br /> County Deed Records, and being over a portion of that 45, more or
