Rogers by Dorys <br /> Rogers McKinnon by deed dated December 22, 1960 and recorded in <br /> Volume 184, Page 631, Hays County Deed Records, and being more <br /> particularly described by metes and bounds on Exhibit A which is <br /> attached hereto and incorporated herein for all purposes, for the <br /> purpose of enabling Grantee to install, lay, construct, <br /> reconstruct and perpetually maintain wastewater pipes and lines <br /> and to have installed, laid, constructed, reconstructed and <br /> perpetually maintained said wastewater pipes and lines in, upon, <br /> across, under and through said easement premises described <br /> hereinabove; <br /> And Grantors do hereby further GRANT, SELL AND CONVEY unto <br /> said Grantee a temporary construction easement on, over and across <br /> a strip of land fifteen feet (15 I) in width running the entire <br /> length of, being parallel with and adjacent to the northwest side <br /> of the hereinabove described permanent easement premises for as <br /> long as is necessary by Grantee to complete construction in the <br /> hereinabove described permanent easement premises, and said <br /> temporary construction easement shall be deemed terminated and <br /> abandoned by said Grantee upon its completion of said <br /> construction, as determined by Grantee; <br /> Grantors hereby expressly retain the right to construct and <br /> maintain a roadway to run parallel with and on, over and across <br /> said permanent easement premises so long as said roadway does not <br /> interfere with the rights acquired by Grantee hereunder. <br /> TO HAVE AND TO HOLD the same perpetually to said Grantee, its <br /> successors and assigns, together with the right and privilege at <br /> any and all times to enter said premises or any part thereof for <br /> the purposes of installing, laying, constructing, reconstructing <br /> and maintaining said wastewater pipes and lines, and Grantors bind <br /> themselves, their heirs, administrators, successors and assigns, <br /> to WARRANT AND FOREVER DEFEND all and singular said premises unto <br /> the Grantee, its successors and assigns, against every person <br /> whomsoever claiming or to lawfully claim the same or any part <br /> thereof. <br />
