CITY OF SAN MARCOS Jo Ann Childress 6903 Deaton Hill, #42 Austin, Texas 78745 To Jo Ann Childress: This letter agreement contains the terms and provisions of the City of San Marcos (City) acquisition of real property owned by you in order to obtain a right-of-way interest in that property. The purpose of this acquisition is to allow the City to make improvements in the Mill Street area. The City hereby agrees: A. to deposit One Thousand Five Hundred Dollars and NO/100s ($1,500.00) into a separate escrow account at a local institution within 14 days of execution of this agreement by both parties. Said sum is the estimated cost of partial demolition and partial reconstruction of the structure located on the subject property and shall be disposed in accordance with the terms of this agreement. City shall pay Jo Ann Childress said $1,500.00 as follows: 1) when the front section of the structure located at 113 Mill Street is removed in accordance with the diagram attached hereto as Exhibit A and incorporated by reference herein for all intents and purposes, and 2) when the area of the proposed right-of-way as described in Exhibit B, attached hereto and incorporated by reference herein for all intents and purposes is vacated by Jo Ann Childress. City shall inspect property within three (3) working days of notification from Jo Ann Childress of work completion. City shall pay consideration in accordance with paragraph A no later than four (4) working days from said inspection assuming approval upon inspection. B. to pay Jo Ann Childress Five Thousand Five Hundred Dollars and NO/IOOs ($5,500.00) upon execution of the instrument described in Paragraph E. below. C. that the water, wastewater, or any other public utility line(s) shall not block the driveway located on the subject property.
