<br /> -7- <br /> unaer the Contract Documents, subject to minor variations from the <br /> Contract Documents correctable prior to completion, and subject to any <br /> specific qualifications stated in the Certificate for Payment); ana <br /> that the Contractor is entitled to payment in the amount certified. <br /> However, the issuance of a Certificate for payment shall not be a <br /> representation that the CONSULTANT has made any examination to <br /> ascertain how and for what purpose the Contractor has used the monies <br /> paid on account of the Contract Sum. <br /> 3.4.13 The CONSULTANT shall have authority to reject Work which <br /> does not conform to the Contract Documents. Whenever, in the <br /> CONSULTANT's reasonable opinion, it is necessary or advisable for the <br /> proper implementation of the intent of the Contract Documents, ana with <br /> the approval of the OWNER, the CONSULTANT will have authority to <br /> require special inspection or testing of the Work in accordance with <br /> the provisions of the Contract Documents, whether or not such Work be <br /> then fabricated, installed or completed. The CONSULTANT shall monitor <br /> and review the Work and results of all testing laboratories as required <br /> by OWNER. <br /> 3.4.14 The CONSULTANT shall conduct professional inspections to <br /> aetermine the Dates of Substantial Completion and final completion, to <br /> eva1 uate the Work for acceptable conformance with the Contract <br /> Documents and in 11ght of any subsequent tests performed as described <br /> in Section 3.4.12 hereof, to verify that any minor deviations from the <br /> Contract Documents as described in Section 3.4.12 hereof have been <br /> corrected and that the reasons for any specific qualifications in any <br /> and all prev io us Certificates For Payment as described in Section <br /> 3.4.12 hereof are either no longer valid or the condition( s) and/or <br /> problem(s) have been corrected. The CONSULTANT shall receive and <br /> rev iew written warranties and related documents required by the <br /> Contract Documents and assembled by the Contractor. The CONSULTANT <br /> shall issue a final Certificate for Payment or take other appropriate <br /> action. And, the CONSULTANT shall make a recommendation to OWNER <br /> regarding OWNER's acceptance of the PROJECT. <br /> 3.4.15 The extent of the duties, responsibilities and <br /> limitations of authority of the CONSULTANT as the OWNER's <br /> representative during construction shall not be modified or ex tenaed <br /> after the Contract Documents have been authorized to be competitively <br /> bid without written consent of the OWNER and the CONSULTANT and with <br /> notice to the Contractor. <br /> 3.4.16 ReVlse contract drawing s (unless complete redrawing is <br /> required) to show the Work as constructed. Furnish a set of the <br /> reproducible record drawings, revised drawings to the OWNER, and <br /> furnish two (2) sets of reproducible record drawings, including airport <br /> layout plan, to the Federal Aviation Administration. <br /> 3.4.17 Consulting services for phase 3 will terminate thirty <br /> (30) calendar days after final acceptance, by the OWNER, of the <br /> construction project. Consulting services after this time will be <br /> accomplished in accordance with provisions of Article 4. <br />
