<br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND
<br /> CONTAINING 3.7463 ACRES OF LAND SITUATED IN A TRACT
<br /> CALL ED THE SECDND TRACT IN A CONVEYANCE FROM A. B. RÅ’ERS
<br /> AND WI LL G. BARBER TO EDWIN C. WILLIS, VOLill-1E 107, PAGE
<br /> 130, DEED RECORDS, T.H.H. FORSYTH ffiRVEY, HAYS COUNTY,
<br /> TEXAS, SAID LAND BEING lOCATED WITHIN THE EXTRATERRITORIAL
<br /> JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRESENT
<br /> CITY OOUNDARIES: APPROVING A SERVICE PLAN FOR SAID TRACT:
<br /> EXTENDING THE roUNDARY LIMITS OF SAID CITY SO AS TO
<br /> INCLUDE SAID TRACT: GRANTIJ\"G TO THE INHABITANTS OF SAID
<br /> TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER CITI ZENS OF
<br /> SAID CITY: BINDING SAID INHABITANTS BY ALL OF THE ACTS AND
<br /> ORDINANCES, RULES AND REGULATIONS OF SAID CITY AND
<br /> DECLARING AN EFFECTIVE DATE.
<br /> 'rJHEREAS, the City Counc il of the City of San Marcos, Texas,
<br /> provided an opportunity for all interested persons to be heard at
<br /> two (2) public hearings, held once on May 12,1986 , and once
<br /> on Nay 13, 1986 , to consider the proposed annexation by the City
<br /> of San Marcos, Texas, of 3.7463 acres of land situated in a tract
<br /> called the f.econd Tract in a conveyance from A. B. Ro;Jers and v'Jill G.
<br /> Barber to Edwin C. '\Tillis, Volume 107, Page 130, Ißed Records,
<br /> T.H.H. Forsyth Survey, Hays County, Texas, and being more
<br /> particularly described by metes and bounds as follows:
<br /> BEGINNING at an iron pin found marking the west corner of this
<br /> tract, the west corner of the called f.econd Tract, the south
<br /> corner of a tract called 9.75 acres in a conveyance recorded in
<br /> Volume 138, Page 364, and situated in the northeast line of a
<br /> tract called the First Tract described in Volume 107, Page 130,
<br /> Ißed Records, Hays County, Texas:
<br /> THENCE with the fenced common line between the called f.econd
<br /> Tract and the called 9.75 acre tract, N47°32' 59" E 341.84
<br /> feet, N 46°30' 27" E 158.1 feet, N 46 '16' 19" E 158.29 feet and
<br /> N 46 °26' 42" E 3.2 feet to a point marking the north corner of
<br /> this tract:
<br /> THENCE S 79°44' E 272.96 feet to a point marking the east corner
<br /> of this tract situated in the cormnon line between the Forsyth
<br /> Survey and the E. Clark Survey;
<br /> THENCE with the fenced common line between the Forsyth Survey
<br /> and the E. Clark Survey, S 46 °30' 27" W 133.61 feet to an iron
<br /> pin found, S 46°33' 22" W 399.12 feet and S 46"17' 42" W 282.47
<br /> feet to an iron pin marking the south corner of this tract, the
<br /> east corner of the called First Tract:
<br /> THENCE with the common line between the called f.econd Tract and
<br /> the called First Tract, N 45 °24' W 226.55 feet to the PLACE OF
<br /> BEGINNING and containing 3.7463 acres of land:
<br /> and,
<br /> VJHEREAS, an on-site public hearing has not been requested in
<br /> writing by more than 20 adults residing in said area: and,
<br /> VJHEREAS, notices of said public hearings were published in the
<br /> San Marcos Daily Record, a newspaper having general circulation in
<br /> said City and in the territory proposed for annexation, on April 27,
<br /> 1986 , and April 29, 1986, said dates being not more than twenty
<br /> (20) days nor less than ten (10) days prior to the hearings for which
<br /> notices were given: and,
<br /> VJHEREAS, prior to the publication of notices of said hearings,
<br /> the City Council of the City of San Marcos, Texas, directed preparation
<br /> of a service plan that provides for the extension of municipal services
<br /> to said area proposed for annexation; and,
<br /> VJHEREAS, said proposed service plan was made available for
<br /> inspection and explained to the inhabitants of the area to be annexed
<br /> at said public hearings: and,
<br /> VJHEREAS, said 3.7463 acres are contiguous and adjacent to
