<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF 0.581 ACRES Of LAND OUT OF THE
<br /> J.M. VERAMENDI LEAGUE NO. 1, CITY OF SAN MARCOS, HAYS
<br /> COUNTY, TEXAS, BEING A PORTION OF THAT TRACT OF LAND
<br /> CONVEYED TO J. GARLAND WARREN BY ALEX G. TIJERINA BY DEED
<br /> DATED JULY 22, 1969 AND RECORDED IN VOLUME 232, PAGE 17,
<br /> HAYS COUNTY DEED RECORDS, LOCATED ON THE SOUTH SIDE OF
<br /> THE 1600 BLOCK OF AQUARENA SPRINGS DRIVE, FROM "ti"
<br /> (SINGLE, DUPLEX, AND NEIGHBORHOOD BUSINESSES DISTRICT)
<br /> TO "C" (COMMERCIAL DISTRICT); AND DECLARING AN EFFECTIVE
<br /> DATE.
<br /> WHEREAS, on March 4, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to change the
<br />zoning from "M" ':SingJe, Duplex, and Neighborhood Businesses District>
<br />to "C" (Commercial District) of 0.581 acres of land out of the J.M.
<br />Veramendi League No. 1, a subdivis¡ in said City; and,
<br /> l.oJHEREAS, subsequent to said publ ic hearing on said date, said
<br />Commission did, on March 4, 1 986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the Ci ty Counc i 1 of said Ci ty; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 9 day
<br />of June , 1986, regarding such request; and,
<br /> WHEREAS, all requ i remen ts of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the Ci ty of San Marcos
<br />pertaining to amendments have been met; and,
<br /> WHEREAS, said Ci ty Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, welfare and safety; now, therefore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned "Mil
<br />(Single, Dup lex, and Neighborhood Businesses District) henceforth
<br />shall be rezoned "C" (Commercial District>:

<br /> WARREN BY ALEX G. TIJERINA BY DEED DATED JULY 22, 1969 AND
<br /> RECORDED IN VOLUME 232, PAGE 17, HAYS COUNTY DEED RECORDS,
<br /> AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
<br /> FOLLOWS, TO-WIT:
<br /> BEGINNING at an iron pipe found at the North corner of the said
<br /> Warren tract, for the North corner of the tract herein
<br /> described, same being on the South line of Texas State Highway
<br /> Loop No. 82, and being the East corner of that trac t of land
<br /> conveyed to H. Garland Stokes by M.D. Heatly by de J dated
<br /> January 3, 1973 and recorded in Vol ume 255, page 670, Hays
<br /> County Deed Records;
<br /> THENCE, leaving the said Stokes tract with the South 1 ine of the
<br /> said Texas State Highway Loop No. 82, the Northeast line of the
<br /> said Warren tract, N 86~5J E, 215.88J feet to an iron pipe
<br /> found at the East corner of the said Warren tract, for the East
<br /> corner of the tract herein described, same being the North
<br /> corner of that 5.520 acre tract of land (Tract No. 2) conveyed
<br /> to H. Garland Stokes by Louis Mecey, et al, by deed dated May
