<br /> ASSURANCES <br /> The applicant hereby assures and certifies that he w1ll comply with the <br /> regulat10ns, policies, guidelines and requirements, 1nc1ud1ng Off1ce of <br /> Management and Budget C1rculars Nos. A-87 and A-1O2, as they relate to the <br /> app11cat1on, acceptance and use of Federal funds for this federally-assisted <br /> project. Also, the applicant g1ves assurance and certif1es w1th respect to <br /> the grant that; <br /> 1. It possesses legal authority to apply for the grant and to f1nance and <br /> construct the proposed fac1l1ties; that a resolut1on, mot1on or similar <br /> action has been duly adopted or passed as an off1c1al act of the <br /> applicant's governing body, authorizing thef1l1ng of the app11cat10n, <br /> includ1ng all understandings and assurances contained therein, and <br /> directing and authoriz1ng the person ident1fied as the official <br /> representative of the applicant to act in connection w1th the app11cation <br /> and to prov1de such add1t10nal information as may be required. <br /> 2. It w111 comply with the provisions of: Executive Order 11988, relating <br /> to evaluat1on of flood hazards, and Execut1ve Order 11990, relating to <br /> protect10n of wetlands. <br /> 3. It w11l have sufficient funds available to meet the non-Federal share of <br /> the cost for construct1on projects. Sufficient funds will be available <br /> when construct1on 1s completed to assure effective operat1on and <br /> ma1ntenance of the fac1lity for the purposes constructed. <br /> 4. It w1l1 obtain approval by the appropriate Federa'l/State agency of the <br /> final working drawings and spec1fications before the project is <br /> advertised or placed on the market for bidding; that 1t will construct <br /> the project, or cause 1t to be constructed, to final completion 1n <br /> accordance with the app11cation and approved plans and spec1ficat1ons; <br /> that it w11l submit to the appropriate Federal/State agency for prior <br /> approval changes that alter the costs of the project, use of space, or <br /> functional layout; that it will not enter into a construction contract(s) <br /> for the project or undertake other act1v1ties unt11 the cond1tions of the <br /> construct1on grant program(s) have been met. <br /> 5. It w1l1 provide and maintain competent and adequate arch1tectura1/ <br /> engineering superv1s10n and 1nspection at the construction site to insure <br /> that the completed work conforms with the approved plans and <br /> specifications; that it will furnish progress reports and such other <br /> 1nformation as the federal grantor agency may reQu1re. <br /> 6. It w", operate and maintain the fac1lity 1n accordance w1th the m1nimum <br /> standards as may be reQu1red or prescr1bed by the app11cable Federal, <br /> State and local agenc1es for the maintenance and operation of such <br /> fac11it1es. <br /> 1. It will give the grantor agency and the Comptroller General through any <br /> authorized representative access to and the r1ght to examine all records, <br /> books, papers, or documents related to the grant. <br /> 3 <br />
