<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF
<br /> THAT ORDINANCE WHICH REGULATES AND RESTRICTS
<br /> THE LOCATION AND USE OF BUILDINGS, STRUCTURES
<br /> AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF 2.99 ACRES, MORE OR
<br /> LESS, OF LAND AREA IN THE J.M. VERAMENDI
<br /> SURVEY NO. 2, BEING A PORTION OF THAT 166.61
<br /> ACRE TRACT DESCRIBED IN A DEED FRO~1 THE SAN
<br /> MARCOS INDUSTRIAL FOUNDATION TO THE BUTLER
<br /> MANUFACTURING COMPANY DATED SEPTEMBER 14, 1978
<br /> AND RECORDED IN VOLUME 331, PAGE 573, HAYS

<br /> CHANGING THE ZONING OF 135.78 ACRES: MORE OR

<br /> 2, BEING A PORTION OF THAT 166.61 ACRE TRACT
<br /> DESCRIBED HEREINABOVE AND BEING A PORTION OF
<br /> THAT 6.80 ACRE TRACT CONVEYED BY C.C. HOLT TO

<br /> 1984 AND RECORDED IN VOLUME 475, PAGE 580,
<br /> HAYS COUNTY REAL PROPERTY RECORDS, FROM "I"
<br /> AND IICII (INDUSTRIAL AND COMMERCIAL DISTRICTS)
<br /> TO IIpUDII (PLANNED UNIT DEVELOPMENT DISTRICT):
<br /> BOTH OF SAID TRACTS BEING LOCATED ON THE WEST
<br /> SIDE OF IH-35 NORTH AND ADJACENT TO BUTLER
<br /> MANUFACTURING COMPANY: APPROVING THE GRANTING
<br /> OF A PERMIT BY THE PLANNING CO~1ISSION FOR A
<br /> PLANNED UNIT DEVELOPMENT ON SAID 135.78 ACRE
<br /> TRACT: APPROVING A PLANNED UNIT DEVELOPMENT
<br /> PLAN FOR SAID 135.78 ACRE TRACT: AND DECLARING
<br /> AN EFFECTIVE DATE.
<br /> WHEREAS, on May 20, 1986, the Zoning Commission of the City
<br /> of San Marcos held public hearings regarding requests changing the
<br /> zoning from III" (Industrial) to "C" (Commercial) of 2.99 acres of
<br /> land area in the J.M. Veramendi Survey No. 2 and changing the
<br /> zoning from "I" and "c" (Industrial and Commercial Districts) to
<br /> IIpUD" (Planned Unit Development District) of 135.78 acres of land
<br /> in the J.M. Veramendi Survey No. 2, both of said tracts being
<br /> located in San Marcos, Hays County, Texas; and,
<br /> WHEREAS, subsequent to said public hearings on said date,
<br /> said Commission did, on May 20, 1986, consider said requests and
<br /> the Zoning Commission voted to approve the same and has
<br /> recommended that said requests be approved by the City Council of
<br /> said City: and,
<br /> WHEREAS, said City Council held public hearings on the ~
<br /> day of June , 1986, regarding said requests: and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code Of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met: and,
<br /> WHEREAS, Section F( 2), Article V, Subdivision Ordinance,
<br /> Appendix C of the Code Of Ordinances of the City of San Marcos
<br /> empowers the Planning Commission of the City of San Marcos to
<br /> grant permits for planned unit developments, subject to review and
<br /> approval by the City Council; and,
<br /> WHEREAS, on May 20, 1986 the Planning Commission of said City
<br /> approved the granting of a permit for a Planned Unit Development
<br /> on said 135.78 acre tract of land in the J.M. Veramendi Survey NO.
<br /> 2: and,
<br /> WHEREAS, Section 34 (C), General Zoning Ordinance, Appendix A
<br /> of the Code of Ordinances of the City of San Marcos requires
<br /> approval by the Zoning Commission of the City of San Marcos of a
<br /> Planned Unit Development Plan; and,
<br /> WHEREAS, on May 20, 1986 said Zoning Commission approved a
