<br /> Planned Unit Development Plan for said 135.78 acre tract of land, <br /> which includes 15.849 acres of public right-of-way in the J.M. <br /> Veramendi Survey No. 2: and, <br /> WHEREAS, said City Council hereby finds and determines that <br /> the adoption of the following ordinance is in the interest of the <br /> pUblic health, morals, welfare and safety: now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the 2.99 acre tract of land area in the J.M. <br /> Veramendi Survey No. 2, more particularly described by metes and <br /> bounds in Exhibit II A", which is attached hereto and incorporated <br /> herein for all purposes, which is presently zoned "I" (Industrial <br /> District) henceforth shall be rezoned "c" (Commercial District). <br /> SECTION 2. That the 135.78 acre tract of land area in the <br /> J.M. Veramendi Survey No. 2, more particularly described by metes <br /> and bounds in Exhibit liB", which is attached hereto and <br /> incorporated herein for all purposes, which is presently zoned "I" <br /> and "c" (Industrial and Commercial Districts) henceforth shall be <br /> rezoned "PUD" (Planned Unit Development District). <br /> SECTION 3. That said Planning Commission's grant of a permit <br /> for a Planned Unit Development of said 135.78 acre tract of land <br /> in the J.M. Veramendi Survey No. 2: more particularly described by <br /> metes and bounds in Exhibit "B", which is attached hereto and <br /> incorporated herein for all purposes is hereby approved. <br /> SECTION 4. That the Zoning Commission's approval of a <br /> Planned Unit Development Plan for said 135.78 acre tract of land <br /> which includes 15.849 acres of public right-of-way, which is <br /> attached hereto and incorporated herein for all purposes as <br /> Exhibit "C", is hereby approved. <br /> SECTION 5. That this Ordinance above shall be in effect ten <br /> (10) days from and after passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following passage, and providing that the Council did not vote to <br /> reconsider them. If reconsidered on July 14, 1986, they shall <br /> be in effect ten days from and after passage on that date if <br /> approved. They shall not go into effect if denied.
