Planned Unit Development Plan for said 135.78 acre tract of land, which includes 15.849 acres of public right-of-way in the J.M. Veramendi Survey No. 2: and, WHEREAS, said City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the pUblic health, morals, welfare and safety: now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the 2.99 acre tract of land area in the J.M. Veramendi Survey No. 2, more particularly described by metes and bounds in Exhibit II A", which is attached hereto and incorporated herein for all purposes, which is presently zoned "I" (Industrial District) henceforth shall be rezoned "c" (Commercial District). SECTION 2. That the 135.78 acre tract of land area in the J.M. Veramendi Survey No. 2, more particularly described by metes and bounds in Exhibit liB", which is attached hereto and incorporated herein for all purposes, which is presently zoned "I" and "c" (Industrial and Commercial Districts) henceforth shall be rezoned "PUD" (Planned Unit Development District). SECTION 3. That said Planning Commission's grant of a permit for a Planned Unit Development of said 135.78 acre tract of land in the J.M. Veramendi Survey No. 2: more particularly described by metes and bounds in Exhibit "B", which is attached hereto and incorporated herein for all purposes is hereby approved. SECTION 4. That the Zoning Commission's approval of a Planned Unit Development Plan for said 135.78 acre tract of land which includes 15.849 acres of public right-of-way, which is attached hereto and incorporated herein for all purposes as Exhibit "C", is hereby approved. SECTION 5. That this Ordinance above shall be in effect ten (10) days from and after passage and after it has been subject to reconsideration by the Council at its next regular meeting following passage, and providing that the Council did not vote to reconsider them. If reconsidered on July 14, 1986, they shall be in effect ten days from and after passage on that date if approved. They shall not go into effect if denied. If not reconsidered or if reconsidered and approved they shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. PASSED, APPROVED AND ADOPTED this the 27th day of June, 1986 , subject to reconsideration at the next regular meeting scheduled for July 14, 1986 .
