A.C. Gonzalez, City Manager June 11, 1986 Page 2 We estimate that the study will be completed within 26 weeks from the date of execution of this Letter Agreement. The total cost to the City for the study is estimated to be $62,500.00. The compensation for planning and engineering services shall be determined as set forth in the attached Schedule "A". The study area is shown in the attached Figure 1. The City and Consultant agree that the total cost of the study for the City shall not exceed $62,500.00 without prior authorization by the City Council and only upon justification for such change. It is understood and agreed that the City shall have complete control of the services to be rendered, and that no billable work shall be done under this Letter Agreement until the Consultant is instructed to proceed with the work. The City agrees to cooperate with the Consultant by providing available data, criteria, and information on pertinent projects which the City has in its posession. The City shall assist member of the project team in gaining access to public and private property as necessary for the completion of a given project. It is agreed that the City or Consultant may terminate or cancel this Agreement upon 30 days written notice of the other, with the provision and understanding that immediately upon receipt of notice of such termination or cancellation from either party to the other all work and labor being performed under this Agreement shall immediately cease, pending final cancellation at the end of such 30-day period. In the event that this Agreement is terminated by either party for any reason whatsoever, the Consultant agrees that, upon request, it ~ill furnish copies of its work papers and drawings to the City, whether completed or not. If you concur and authorize the above described study to be conducted in accordance with this Letter Agreement, please sign the original and a copy of this Letter Agreement and return the original to me.
