RESPONSIBILITY OF THE CUSTOMER (Continued) <br /> All travel-related expenses, including travel time, are chargeable. <br /> Time required and expenses incurred to incorporate enhancements and <br /> improvements in Customerls existing programs are chargeable. <br /> Customer will be charged for all program modifications and <br /> associated training. <br /> Customer will be responsible for all magnetic media necessary to <br /> retain proper backup of the software. <br /> Customer will be responsible for all long distance telephone <br /> charges. <br /> 7. MAINTENANCE LIMITATIONS AND EXCLUSIONS <br /> CPS will be under no obligation to furnish as part of the <br /> maintenance charges any assistance or enhancements because of the <br /> reasons liste.d below. Time spent on assistance or delays arising <br /> from the following causes will be invoiced and paid at CPSI then <br /> current standard systems analyst rate. <br /> A. Accident, fire or other hazard, transportation, neglect, <br /> misuse, or any other cause beyond the range of normal <br /> usage. <br /> B. Software which has been modi£ied by non-CPS personnel. <br /> C. Failure of Customer to allow CPS access to the equipmen t. <br /> D. Operator or user error. <br /> E. Operator training. <br /> 'rhis Agreement does not include: <br /> A. Installation, deinstallation¡ and reinstallation <br /> of software listed under this Agreeme.nt. <br /> B. Diagnostics or repair of hardware. <br /> C. New programs or undeveloped systems that are not <br /> considered enhancements to existing programs. CPS <br /> will have the right to determine what ~s an <br /> enhancement or a new program that the Customer <br /> must. license from CPS. <br />
