SOFTWARE SUPPORT AGREEMENT TERMS AND CONDITIONS 2. 'I'ERM OF COVERAGE Subject to final approval by a duly authorized representative of CPS Business Systems, Inc., this Agreement is effective on the date it is executed by CPS. Maintenance coverage for each item of software shall begin on the commence date as identified in this Agreement and shall continue for an initial period of one year. Thereafter, this Agreement shall be automatically extended under these same terms and conditions. 3. MAINTENANCE COVERAGE CPS will provide as part of this Agreement enhancements and improvements to CPS standard programs licensed by the Custome.r and listed in Paragraph 1 of this Agreement. "Enhancements" are defined as features added to existing applications which would be considered valuable and usable (i.e., additional reports or add~tional information maintained in the program). "Improvements" are change.s made to applications which improve operator and/or system performance. CPS will provide as part of this Agreement operator assistance by telephone covering Customer questions and/or problems on progcams listed in this Agreement. (Long distance phone charges are not covered. See paragraph 5, "Responsibilities of. the Customer...") CPS will provide updated versions of the 'rexas Instruments Operating System at Customerls request if this software is listed in this Agreement. Basic Service Availability Period is irom 8 a.m. to 5 p.m. ¡ Monday through Friday, excluding major holidays. CPS also offers three (3) different extended serv~ce periods for software maintenance probems. These extended per i 0 d s are for emergencies only and not an extension of our full service period of 8 a.m. to 5 p.m. Extension (l) offers two choices: A. 8 a.m. to to 12 p.m., Monday through Friday, excluding holidays. B. 8 a.m. to 5 p.m. tor a seven day week¡ excluding holidays. Extension (2) is 8 a.m. to 12 p.m. for a seven day week excluding hol~days.
