<br /> ~lliEREAS, prior to the publication of notice of said hearings,
<br /> the City Council of the City of San rvlarcos, Texas, directed preparation
<br /> of a service plan that provides for the extension of municipal services
<br /> to said area proposed for annexation; and,
<br /> "\tMEREAS, said proposed service plan was made available for
<br /> inspection and explained to the inhabitants of the area to be annexed
<br /> at said public hearings; and,
<br /> WHEREAS, said 141.95 acres are contiguous and adjacent to the
<br /> current boundaries of the City of San Marcos, Texas; now, therefore,
<br /> BE IT ORDAINED BY THE CITY mUNCIL OF THE CITY OF SAN MARCOS,
<br /> TEXAS:
<br /> SECTION 1. That the following described property, being 141.95
<br /> acres of land adjoining the existing city limi ts of the City of San
<br /> ~4arcos , Texas, out of the J .~'1. Veramendi league No.1, A-17, and the
<br /> James Curtis Survey, A-3, Hays County, Texas, and being rrore
<br /> particularly described by metes and bounds as follows:
<br /> BEGINNING at a fence corner post for the south corner of the
<br /> above referenced ~~er 136.80 acre tract, same being the west
<br /> corner of that 319.6445 acre tract of land described in a deed
<br /> from Theodora Scrutchin, et alius, to Jim R. 9nith dated July
<br /> 31, 1979 and recorded in Volume 330, Page 61 of the Hays County
<br /> Deed Records, in the northeast line of F.M. Highway i\o. 621;
<br /> THENCE leaving the PLACE OF BEGINNING and the Emi th tract Irlith
<br /> the commonline of F.M. Highway No. 621 and the IWyer 136.80 acre
<br /> tract and the DI.¡yer 5.00 acre tract, the fol101.^ling four courses:
<br /> 1. N46 ° 08' 17 "w 1552.96 feet to a concrete highway monument
<br /> found at the beginning of a right-breaking curve,
<br /> 2. "ltJith said right-breaking curve having the following
<br /> characteristics: central angle = 25° 56'24", radius =
<br /> 676.29 feet, arc length = 306.28 feet, and a chord which
<br /> bears N33 ° 14' 19"\<.; 303.57 feet to a concrete highway
<br /> monument,
<br /> 3. N20 ~O '44"W 85.87 feet to a concrete highway monument at
<br /> the beginning of a left-breaking curve, and
<br /> 4. \.¡¡ith said left-break ing curve having the following
<br /> characteristics: central angle = 06 ° 13' 39", radius =
<br /> 1197.66 feet, arc length = 130.17 feet, and a chord which
<br /> bears N23 ° 27' 03 "~^J 130.11 feet to a point inside of a
<br /> uitlity pole, for the \r~st corner of the Dwyer 5.00 acre
<br /> tract and the south corner of that tract described as
<br /> 57.67 acres in a deed from S.R. Willcockson, et alius to
<br /> Peter A. Dwyer, trustee da ted October 11, 1983 and
<br /> recorded in Volume 404, Page 317 of the Hays County Deed
<br /> Records, pass at approximately 399.03 feet along the arc
<br /> length, the common corner of the Dwyer 136.80 acre tract
<br /> and the Dwyer 5.00 acre tract;
<br /> THENCE leaving F.M. 621 with the commonline of the Dwyer 57.67
<br /> acre tract and the Dwyer 5.00 acre tract the following four
<br /> courses:
<br /> 1. N49 °37' 26"E 242.45 feet to a fencepost,
<br /> 2. N 16°51' 35"E 190.68 feet to an 1/2 inch iron rod,
<br /> 3. N 45°00'00"E 541.76 feet to an 1/2 inch iron rod for the
<br /> north corner of the Dwyer 5.00 acre tract, and
<br /> 4. S 45 °00 'OO"E 337.22 feet to an 1/2 inch iron rod for the
<br /> east corner of the [)¡,.¡yer 5.00 acre tract and the easterly
<br /> south corner of the ~.¡yer 57.67 acre tract;
<br /> THENCE leaving the Dwyer 5.00 acre tract with the cornmonline ofo
<br /> the ~'¡yer 136.80 acre tract and the T)..1'{er 57.67 acre tract N 47
<br /> 16' 41"E 2416.71 feet to an iron rod set in October, 1980 on the
<br /> approximate low bank of the San Marcos River;
