<br /> -5- <br /> of the inception of each policy by the insurance company. <br /> The min~mum limits of any insurance coverage required herein <br /> shall not limit Lessee's liab~lty under Paragraph 10 of th~s <br /> Agreement. <br /> 10. Indemnity. <br /> Lessee agrees to indemnify and hold harmless the Lessor, the <br /> C~ty of San Marcos, its employees, agents, officers, and <br /> servants, from all damages, claims, losses, demands, suits, <br /> Judgments, costs and expenses arising from the conduct by <br /> Lessee, its agents or employees, at Airport ana shall defend <br /> any litigation ar~sing in connect~on with such operation. <br /> 11. Lessee's Use of Airport Facilities. <br /> Dur~ng the term of this lease, the Lessor agrees that Lessee <br /> shaLL have and enjoy quiet and undisturbed possession of the <br /> demised premises and all appurtenances appertain~ng thereto, <br /> together with the right to use the runways and taxiways of <br /> the A1rport as contemplated herein; providea, however, that <br /> this lease is subject to the prior approval of the Federal <br /> Aviat~on Administration, and the rights of the Unitea States <br /> of Amer~ca to have exclusive or non-exclusive use, control <br /> and possession without charge, of the Airport or any portion <br /> thereof during per10ds of Nat~onal Emergency¡ ana further <br /> subject to the right of the Federal Aviation Administration <br /> and United States Government to take a portion of the A1rport <br /> premises for a1r traffic control activities related to a~r <br /> traffic control, all as provided ~n sa1d heretofore described <br /> Indenture. It is understOOd and agreed by and. between the <br /> parties hereto that the continuing use of the Airport as an <br /> airport for general av~at10n is essential to the operation of <br /> Lessee and that failure to cont~nue the use of the Airport <br /> for airport and aviation purposes shall const~tute a default <br /> in the lease agreement; and upon giving notice by Lessee to <br /> Lessor of such default and fa11ure to cure such default <br /> w1th1n thirty (30) days after the giving of such notice, th~s <br /> lease shall terminate and end as of the date 120 days after <br /> such not1ce shall have been g1ven¡ and Lessee shall thereupon <br />
