<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />) MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 19B4 (VOL. 66) BY
<br />ZONING PREVIOUSLY UNZONED PROPERTY AS "R-2" (SINGLE-FAMILY
<br />DWELLING DISTRICT), BEING 42.95 ACRES, MORE OR LESS, OF
<br />LAND IN THE J.M. VERAMENDI SURVEY NO.1, AND THE B.
<br />O¿KANE SURVEY, BEING A PORTION OF THAT TRACT DESCRIBED AS
<br />75 PERCENT OF 62.235 ACRES IN A DEED FROM JIM R. SMITH TO
<br />JAY WILLIAMSON, TRUSTEE DATED JUNE 5 1985 AND RECORDED IN
<br />VOLUME 529, PAGE 250 OF THE HAYS COUNTY REAL PROPERTY
<br />RECORDS AND THAT TRACT DESCRIBED AS 25 PERCENT OF 62.235
<br />ACRES IN A DEED FROM SECOND BAPTIST CHURCH TO JAY
<br />WILLIAMSON, TRUSTEE DATED JUNE 4, 1985 AND RECORDED IN
<br />VOLUME 529, PAGE 254 OF THE HAYS COUNTY REAL PROPERTY
<br />RECORDS, AND LOCATED IN THE VICINITY OF FM 621; AND
<br />DECLARING AN EFFECTIVE DATE.

<br />
<br />WHEREAS, on June 3, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to zone
<br />pre\.,iously unzoned property as "R-2" (Single Family D!A!elli.ng
<br />District), being 42.95 acres, more or less of land in the J.M.
<br />Veramendi Survey No.1 and the B. O~Kane Survey in the City of San
<br />Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said publ ic hearing on said date, said
<br />Commission did, on June 3, 1986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />l4HEREAS, said City Council held a public hearing on the 11 day
<br />of August, 1986, regard i ng such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />Unzoned henceforth shall be zoned "R-2" (Single Family Dwelling
<br />District):
<br />
<br />DESCRIPTION OF 42.95 ACRES, MORE OR LESS, OF LAND IN THE J.M.
<br />VERAMENDI SURVEY NO.1, AND THE B. O~KANE SURVEY, BEING A
<br />PORTION OF THAT TRACT DESCRIBED AS 75 PERCENT OF 62.235 ACRES IN
<br />A DEED FROM JIM R. SMITH TO JAY WILLIAMSON, TRUSTEE DATED JUNE
<br />5, 1985 AND RECORDED IN VOLUME 529, PAGE 250 OF THE HAYS COUNTY
<br />DEED RECORDS AND THAT TRACT DESCRIBED AS 25 PERCENT OF 62.235
<br />ACRES IN A DEED FROM SECOND BAPTIST CHURCH TO JAY WILLIAMSON,
<br />TRUSTEE DATED JUNE 4, 1985 AND RECORDED IN VOLUME 529, PAGE 254
<br />OF THE HAYS COUNTY DEED RECORDS AND BEING MORE PARTICULARLY
<br />DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

<br />COMMENCING at an 1/2 inch iron rod found for the north corner of
<br />the Will iamson 62.235 acre tract in the southwest 1 ine of F.M.
<br />Highway No. 621;
<br />
<br />THENCE leaving the PLACE OF COMMENCEMENT with the common 1 ine of
<br />F.M. Highway No. 621 and the Will iamson 62.235 acre tract the
<br />following four courses:
<br />
<br />1. With a right-breaKing curve having the following
<br />characteristics; Delta = 07°45¿O9", Radius = 1105.91 feet,
<br />ARC = 149.64 feet, and a Chord bearing of S24°10'09"E
<br />149.52 feet to a Texas Highway Department concrete
<br />monument found,
