<br /> 1.6.1 hereof, and in such event, ARCHITECT shall be compensated as <br /> provided in Sectlon 14.2.1 hereof. <br /> 3.2.3 If the lowest bona fide bid exceeds the Fixed Limit of <br /> Constructlon Cost established as a condition of this Agreement, the <br /> OWNE R shall ( 1) give written approval of an increase ln such fixed <br /> limlt, (2) authorize rebidding or renegotiating of the Project(s) <br /> within a reasonable time, or (3) cooperate in revising the project(s) <br /> scope and quallty to reduce the Construction Cost. Services provlded <br /> by the ARCHITECT regarding items (2) and (3) above or other actions <br /> requested by the OWNER in writing shall be undertaken as an additlonal <br /> service and as such compensation shall be in accordance with Section <br /> 14.2.1 hereof. During the development of the pro]ect(s) through the <br /> phases described by Article 1 of this Contract and prior to final <br /> approval of contract documents, plans and speclfications by the OWNER, <br /> the ARCHITECT shall monitor the probable construction cost ln relatl0n <br /> to the established fixed 11mit. If necessary, the ARCHITECT shall <br /> implement construction costs savings measures or otherwise endeavor to <br /> limit probable construction cost to the level of available funds set by <br /> the OWNER. <br /> ARTICLE 4 <br /> DIRECT PERSONNEL EXPENSE <br /> 4.1 Direct Personnel Expense is defined as the direct salaries of <br /> all the ARCHITECT's personnel engaged on the project(s). <br /> ARTICLE 5 <br /> REIMBURSABLE EXPENSES <br /> 5.1 If indicated in Article 14, reimbursable expenses are in <br /> addition to the Compensation for Basic and Additional Services and <br /> include actual expenditures made by the ARCHITECT and the ARCHITECT's <br /> empJ.oyees and consultants ln the interest of the Project for the <br /> expenses listed in the following Subparagraph: <br /> 5.1.1 printing costs for the printing of construction contract <br /> documents, long distance calls, travel expenses outside of San Marcos, <br /> expenses incurred for delivering constructlon contract documents <br /> out-of-town (i.e., bY express mail, federal express, bus, hand <br /> delivery), materials cost and/or duplication expenses incurred for <br /> public meetings. <br /> -11- <br />
