<br /> to continue to render CUSTOMER bills in the name of CITY bu~ <br /> will not be liable for any consequences associated with delayed <br /> billings after December 31, 1986, due to the failure of LCRA's <br /> existing computer equipment. Upon the effective date of <br /> assumption by CITY of CUSTOMER billing, LCRA's responsibility <br /> for the duty assumed by CITY shall cease. <br /> LCRA agrees during the time it is obligated to <br /> perform CUSTOMER billing under this Agreement, to provide the <br /> hardware, software and hardware maintenance. Until December <br /> 31, 1986, CITY shall be obligated to pay its pro rata share <br /> (based upon the total number of retail customers being billed <br /> monthly by LCRA) of one-half of the total cost of LCRA's cost <br /> to provide such Burroughs-related hardware, software and <br /> hardware maintenance. After December 31, 1986, CITY shall be <br /> obligated to pay LCRA its full pro rata share of LCRA's total <br /> cost for Burroughs-related hardware, software and hardware <br /> maintenance used to perform CUSTOMER billing for CITY. At such <br /> time as LCRA transfers to CITY its CUSTOMER billing duties, <br /> CITY shall not be obligated to make any further payments to <br /> LCRA for the hardware, software or hardware maintenance <br /> formerly used to perform CUSTOMER billing services. LCRA <br /> agrees to provide full assistance to CITY in the transfer of <br /> CUSTOMER billing duties. <br /> -9- <br />
