<br /> data in the format proposed by CITY such that CITY may <br /> maintain, in a timely manner, a complete and accurate CUSTOMER <br /> history record. <br /> 2.9 LCRA shall exercise due diligence to collect all <br /> amounts due CITY for electric power and energy delivered to <br /> CUSTOMERS; provided, however, CITY shall be responsible for any <br /> legal proceedings to collect utility billings. Until CITY <br /> assumes the responsibility for rendering the CUSTOMER bills, <br /> LCRA shall provide CITY monthly with a Billing and History <br /> Register. CITY shall provide LCRA with its Customer Adjustment <br /> Guidelines and Procedures and LCRA shall administer that <br /> policy. All moneys collected by LCRA shall be immediately <br /> deposited in CITY's "Electric Utility Account" as set forth in <br /> Section 3.2 <br /> 2.10 LCRA shall make recommendations and CITY shall <br /> review and approve all capital improvements to the SYSTEM, the <br /> manner and methods of financing and the manner of constructing <br /> same. Capital improvements to the SYSTEM may be constructed <br /> under a contract bid awarded by CITY or may be constructed by <br /> LCRA acting for CITY under this Agreement. In the event <br /> capital improvements are constructed under contract bid and <br /> awarded by CITY, upon request of CITY, LCRA shall act as CITY's <br /> -11- <br />
