<br /> -4- <br /> to construction to determine that such construction is in <br /> accordance wlth varlous app.l1.caole cOdes and ordinances and <br /> the uses and purposes contemplated by this lease agreement, <br /> and that the same wlll not constitute a flre or safety hazard <br /> or interference in the use of the remainder of the Airport by <br /> the general av1.ation pUblic; provided, however, that such <br /> consent shall not be unreasonab.ly withheld bY Lessor. The <br /> hangar to be constructed by Lessee shal.l not lnterfere with <br /> any height restrictions. No mechanic's and materialman's <br /> lien shall be fixed against any of the demised premises. <br /> 8. Utilities <br /> Lessee shall have the r1.ght to use the utility service <br /> facillties located on the prem1.ses at the commencement of the <br /> term of thlS lease. Additionally, should Lessee's operations <br /> or construction of lmprovements requlre additional util1.ty <br /> service fac1.lities, Lessee agrees to provide such facilities <br /> at its own expense. Lessee agrees to pay all utility charges <br /> incurred as a result of Lessee's operation when due. <br /> 9. Insurance <br /> Lessee shall maintain at his own cost and expense publ1.c <br /> liability lnsurance on an occurrence basis with minimum <br /> I1mlts of liaoility in an amount of $100,000.00 for bodily <br /> injury, personal lnjury or death to anyone person: up to <br /> $300,000.00 for each occurrence and $100,000.00 for damage to <br /> property and property damage insurance on the leasehold <br /> improvements ln an amount not less than the fair market value <br /> thereof; and such insurance policy (pol1.cies) shall contain <br /> the endorsement that such insurance may not be cancelled or <br /> amended with respect to Lessee without thirty (30) days' <br /> prior written notice by registered mail to Lessor by the <br /> lnsurance company and that Lessor shall not be required to <br /> pay any premlums for insurance. Any insurance policy herein <br /> required or procured by Lessee shall contain an express <br /> walver of any rights of subrogation oy the insurance company <br /> against the Lessor. A copy of all such insurance policles <br /> shall be delivered by Lessee to Lessor within ten (10) days <br />
