That SUbsection 36(J) of the GeneraL Zoning <br />Ordinance of the San Marcos Coae of Orainances is herebY repeaLed. <br /> <br />SECTION 35. That new Subsection 36(J) of the General <br />Zoning Orainance of the San Marcos COde of Ordinances is herebY <br />adopted to read as folLOWS: <br /> <br />(J) Fences or shrubbery in residential zoning <br />districts in the requirea front or side yard adjacent to <br />a street shall not Obstruct the view of motorists <br />traveling on saia streets, and shall not inhiblt nor <br />lnterfere with the safe movement of vehicular traffic as <br />determinea by the Chief of Police or his designee, but <br />in no event shalL fences exceed four feet in helght in <br />the requirea front yard or six feet in height in the <br />requirea side and rear yards, nor shaLL any fence, waLL, <br />or shrUbbery exceed the 11mits proviaed in Section 36(K) <br />and Section 36(L), beLOW. <br /> <br />SECTION 36. That Section 36 of the GeneraL Zoning <br />OraJ.nance of the San Marcos COde of Ordinances is hereby amendea <br />by the aadition of Subsections Kana L to read as follows: <br /> <br />(K) On any corner Lot on which a front yard and <br />exterior side yara are required, no walL, fence, sign or <br />other structure, vehicLe or pLant growth having a height <br />in excess of three feet above the eLevation of the <br />lowest point of the crown of the adjacent street shall <br />be maintained in a trlangle formea by measuring a <br />distance of 25 feet along both property Lines from their <br />point of intersection and connnecting the pOlnts so <br />established to form a triangle except, however, that a <br />single pOLe 18 lnches or less in diameter supporting a <br />permitted sign, or sJ.ngle tree trunk, may be placed in a <br />sight triangle, provided that the bottom of the slgn or <br />lowest tree branch when mature does not Obstruct the <br />vJ.ew of motorists traveling on the adjacent streets or <br />interfere with the safe movement of vehicular trafflc as <br />determinea bY the Chief of POLice or his aesignee. <br /> <br />(L) On any Lot on which a private driveway, <br />serving uses other than single or two-famJ.ly aweLllngs, <br />intersects a pUblic street, a sight triangle havlng the <br />same llmitations as Section 36(K) aoove, shaLL be formea <br />by measuring a distance of 15 feet along the <br />right-of-way Line and edge of the curb cut from theJ.r <br />point of intersection and connecting the points so <br />establlshea. <br /> <br />SECTION 37. That Section 39, Nonconforming Uses, of the <br />General Zoning Ordinances of the San Marcos Coae of Oralnances is <br />herebY renamed Nonconformities. <br /> <br />SECTION 38. That Section 39 of the General Zonlng <br />Oralnance of the San Marcos Coae of Orainances is hereoy amenaed <br />by the aaoption of SUbsection (E) to read as folLOWS: <br /> <br />(E) Nonconforming lots: A nonconformlng lot as <br />definea ln Section 4 (72.5) J.S Lawful if it is shown bY <br />a recordea plat or deed to have been owned separateLY <br />and inaividually from adjoining tracts of land at a time <br />when the creation of a lot of such size and/or wlath at <br />
