<br />-7- <br /> <br />Engineering, or his designated representative, <br />shall inspect the premises of each such facility <br />approved pursuant to this ordinance at least once <br />per year. Where noncompliance is found, the City <br />shall request in writing that the property owner <br />comply. This notice shall describe the measures <br />required to be taken. If, within thirty (30) days <br />of notice, the maintenance required is <br />not accompl ished, the City may bring action in a <br />court of competent jurisdiction to require the <br />property owner to accompl ish necessary <br />maintenance. "Necessary maintenance" is that <br />maintenance needed to bring the facil ity and/or <br />improvement into compl iance with this or other <br />ordinances, Jaws, or regulations <br /> <br />k. <br /> <br />Required Plans. <br /> <br />(1) No plat in the drainage basin of the outcrop of the <br />Edwards and Associated Limestone shall be <br />approved by the Planning Commission until all <br />plans designed to meet the standards of <br />subsection 4.j have been reviewed and a <br />recommendation made on them by the Director of <br />Environment and Engineering. Such recommendation <br />shall be subject to the plans' compliance with <br />all pertinent laws, ordinances and regulations. <br />These plans shall be submitted to the Director <br />of Environment and Engineering as part of the <br />site development plans required by the <br />Drainage and Erosion Control Ordinance. <br /> <br />(2) No plans and specifications called for in <br />subsection 4.j shall be accepted or reviewed <br />by the Director of Environment and Engineering, or <br />his designated representative, unless accompanied <br />by the certification of a registered professionaJ <br />engineer practicing in Texas that: <br /> <br />(a) The development plan is complete; and, <br /> <br />(b) The technical and engineering requirements <br />subsection 4.j are met. <br /> <br />of <br /> <br />(3) The applicant shall submit with the plat a cop>, of <br />the Water Pollution Abatement Plan, which is <br />required by the Edwards Rules of the Texas Water <br />Commission. If said plan is required by the <br />State of Texas, but is not submitted by the <br />appl icant with the appl icant's plat, the Planning <br />Commission shall deny approval of the plat. <br /> <br />1. <br /> <br />These regulations (subsection 4, Section M, Article VI, <br />Subdivisions) are not appl icable to lots that are <br />properly platted and recorded unless a properlY <br />platted and recorded lot is subsequently re-subdivided. <br /> <br />SECTION 5. That all the provisions of this Ordinance shall apply <br />to all subdivisions which have not received final plat approval on the <br />effective date of this Ordinance. <br /> <br />SECTION 6.
