ORDINANCE NO. 2013-62 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE PREFERRED <br />SCENARIO MAP FROM AN "AREA OF STABILITY" TO A "MEDIUM <br />INTENSITY ZONE" FOR 192.804 ACRES MORE OR LESS SUCH LAND <br />BEING GENERALLY LOCATED SOUTH OF YARRINGTON ROAD <br />BETWEEN IH 35 AND POST ROAD AND EXTENDING SOUTH TO THE <br />BLANCO RIVER MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A <br />50.339 ACRE TRACT, A 54.966 ACRE TRACT AND A 50.003 ACRE TRACT <br />ALL OUT OF THE WILLIAM WARD SURVEY NO. 3, ABSTRACT NO. 4679 <br />HAYS COUNTY AND LOTS 19 29 39 6 THRU 169 23, 24 AND 25 OF THE <br />CHAMPIONS BUSINESS PARK SUBDIVISION, HAYS COUNTY, <br />CONSISTING OF APPROXIMATELY 37.494 ACRES MORE OR LESS; AND <br />INCLUDING PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On October 8, 20135 the Planning and Zoning Commission of the City of San Marcos held a <br />public hearing regarding a request to change the Preferred Scenario Map of the Comprehensive Plan <br />Vision San Marcos: A River runs Through Us, for 192.804 acres of land generally located south of <br />Yarrington Road between IH 35 and Post Road, extending south to the Blanco River from an "Area <br />of Stability" to a "Medium Intensity Zone ". <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to recommend approval of the request on October 8, 2013 to amend the <br />Preferred Scenario Map of the Comprehensive Plan from an "Area of Stability" to a "Medium <br />Intensity Zone" while preserving the Open Space designation for the floodway and water quality zone <br />on the Preferred Scenario Map. <br />3. The City Council held a public hearing on November 6, 2013 regarding the request. <br />4. All requirements of CHAPTER 1, DEVELOPMENT PROCEDURES, OF THE CITY LAND <br />DEVELOPMENT CODE pertaining to Preferred Scenario Map Amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following ordinance is <br />in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />1 <br />
