That certain 0.27 acre, more or less, tract or parcel of land in the City of San <br />Marcos, Hays County, Texas out of the T.J. Chambers League, as described by metes and <br />bounds in the Deed from Lou H. Froh, Executor of the Estate of Joe C. Froh, Jr., to the City <br />of San Marcos, recorded in Volume 2097, Page 571 of the Official Public Records of Hays <br />County, Texas; and <br />L That certain 0.57 acre, more or less, tractor parcel of land, being a portion of Lots <br />64 and 65 in the Second Division of the Park Addition in the City of San Marcos, Hays <br />County, Texas as described by metes and bounds in the Deed from Francis R. Horne to the <br />City of San Marcos, recorded in Volume 751, Page 145 of the Official Public Records of <br />Hays County, Texas. <br />SECTION 2. The dedication of said tracts of real property shall include, subject to <br />applicable laws, the sections of any unimproved rights -of -way that are abutted on both sides by City - <br />owned property. <br />SECTION 3. The dedication of said tracts of real property and sections of rights -of -way for <br />park purposes is subject to, and there is hereby reserved and excepted from such dedication, a <br />blanket easement across said tracts for any and all utilities, including drainage utilities, and any other <br />easements of record, together with all rights of ingress and egress, as necessary, for purposes of <br />operating, maintaining, repairing, upgrading and replacing improvements, facilities and <br />appurtenances related to such utilities. The City further reserves the right to install park roads and <br />parking lots, and other facilities and amenities that support lawful park purposes. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 6.
