<br />Notwithstanding any of the above, any LCRA employee <br /> <br />who is scheduled to retire within the initial five (5) year <br />term of this Agreement, shall retire under the LCRA Retirement <br /> <br />System. <br /> <br />LCRA shall preserve the accumulated retirement bene- <br /> <br />fits of LCRA employees assigned to the San Marcos district who <br /> <br />subsequently become CITY employees. <br /> <br />The retirement benefits <br /> <br />shall include but not be limited to employee contributions, <br /> <br />employer contributions, accrued interest on contributions, and <br /> <br />any vested values. <br /> <br />Upon transfer of any LCRA employee to the <br /> <br />status of CITY employee, LCRA shall transfer the present value <br />of the total accrued retirement benefits to CITY for the <br /> <br />account of individual employees. <br /> <br />ARTICLE 8 <br />LIABILITY <br /> <br />8.1 <br /> <br />LCRA agrees that CITY does not employ personnel <br /> <br />experienced in the management, operation, maintenance and con- <br /> <br />struction of electric utility facilities and has no knowledge <br />of what is required for the service, reliability, efficiency <br /> <br />and economical operation of the SYSTEM. <br /> <br />LCRA employs experi- <br /> <br />enced personnel with full knowledge of what the safe, reliable, <br />efficient and economical operation of the SYSTEM entails. <br /> <br />LCRA, as Operating Agent under this Agreement, shall exercise <br />all of its powers and discharge all of its duties under its <br /> <br />-27- <br />
