<br />of the LCRA employees located in San Marcos performing the <br /> <br />functions. <br /> <br />Such transfer will in no way diminish the intent or <br /> <br />essence of this Agreement. <br /> <br />The above provision may be implemented without arbi- <br /> <br />tration if the LCRA local manager determines that the effi- <br />ciencyand integrity of the SYSTEM operations and management <br /> <br />will be preserved. <br /> <br />If he makes no determination, the LCRA 10- <br /> <br />cal manager, upon receipt of notice by CITY to transfer func- <br /> <br />tions, may request arbitration under the rules and procedures <br /> <br />of the American Arbitration Association by notifying CITY <br />thereof in writing not more than thirty (30) days following <br /> <br />receipt of notification of CITY's request. <br /> <br />In the event CITY assumes any functions of LCRA dur- <br /> <br />ing the term of this Agreement, as provided above, which would <br /> <br />cause a reduction in force, CITY agrees that any reduction in <br /> <br />force will be accomplished only by attrition or only after any <br /> <br />affected employee has been offered CITY employment with minimal <br /> <br />impact on those employees' compensation. <br /> <br />-26- <br />
