<br />(2 ) <br /> <br />( 3) <br /> <br />A person may not be required to disclose any classified data <br />of the federal government or any confidential information <br />relating to secret processes or economics of operation. If <br />the information constitutes a trade secret or is commercial <br />or financial information privileged or made confidential by <br />statute or judicial decision or if it is information which <br />if released, would give advantage to competitors, then the <br />information is not open to public inspection and shall be <br />kept in confidence by the City. A person submitting data <br />or information may request that it be classified as <br />confidential. However, the composition of any waste <br />subject to the jurisdiction of this Ordinance may not be <br />regarded as confidential information. <br /> <br />Chemical disclosure lists shall <br />within ten (10) days of the <br />Ordinance. Subsequent changes <br />made within seven (7) days of <br />effective. <br /> <br />be filed with the Director <br />effective date of this <br />in a person's list shall be <br />the date the changes are <br /> <br />SEC. 30-67. <br /> <br />( 1 ) <br /> <br />( 2 ) <br /> <br />Remedies. <br /> <br />Any person violating any of the provisions of this Ordinance <br />shall become liable to the City for any expense, loss, or <br />damage occasioned by the City by reason of such violation. <br /> <br />The purpose of this Ordinance being to promote the health, <br />recreation, safety and welfare of the public, any discharge <br />by a person contrary to the provisions of this Ordinance is <br />declared to be a public nuisance and any other person may <br />apply to any court of competent jurisdiction for any may <br />obtain an injunction restraining violation of this <br />Ordinance. Such proceedings shall be guided by the rules of <br />other injunction proceedings. The City Attorney is <br />authorized to file suit for an injunction whenever he or she <br />has reasonable cause to believe an ongoing violation of the <br />ordinance exists. <br /> <br />SEC. 30-68. <br /> <br />Other Sections Applicable. <br /> <br />Other sections of the City of San Marcos Code of Ordinances <br />dealing with cross connections, items pertaining to safeguarding <br />the water supply, items safeguarding the sanitary sewer system and <br />waste traps remain applicable. <br /> <br />SEC. 30-69. <br /> <br />Conflict with other Laws. <br /> <br />Compliance with this section does not exempt or excuse a person <br />from complying with the provisions of the Texas Water Code or the <br />requirements of any applicable waste discharge permit, order, <br />rule, or regulation issued by the Texas Water Commission. <br /> <br />SEC. 30-70. <br /> <br />Penalties. <br /> <br />Any person who violates any of the provisions of this Ordinance is <br />guilty of a misdeameanor, and upon conviction shall be punished by <br />a fine not less than two hundred dollars ($200.00) or more than <br />one thousand dollars ($1,000.00) for each offense. Each day of <br />violation constitutes a separate offense. <br /> <br />SEC. 30 - 71 . <br /> <br />Separability. <br /> <br />If any provision, section, sentence, clause or phrase of this <br />Ordinance, or its application to any person or set of <br />circumstances is for any reason held to be unconstitutional, void <br />or invalid (or for any reason unenforceable), the validity of the <br />remaining portion of this Ordinance or its application to other <br />persons or sets of circumstances shall not be affected thereby, it <br />being the intent of the City Council of the City of San Marcos in <br />adopting and of the Mayor in approving this Ordinance, that no <br />portion of it or provision or regulation contained in it shall <br />become inoperative or fail by reason of any unconstitutionality or <br />invalidity of any other portion, provision or regulation. <br /> <br />-18- <br />
