37 Special Meeting July 7,1986 Page 3 FOR OUT-OF-DISTRICT SERVICE: ESTABLISHING A FEE FOR REVIEW OF CREATION PETITIONS, COMPLETING CONSENT AGREEMENTS, REVIEWING ENGINEERING AND LAND USE AND TRANSPORTATION PLANS, IMPACT DISTRICTS WITHIN THE CITY'S LIMITS AND ITS EXTRATERRITORIAL JURISDICTION: ESTABLISHING BASIC QUALIFICATIONS FOR CONSENT TO THE CREATION OF A UTILITY DISTRICT; PROVIDING PERCENTAGES ALLOWED FOR BOND FINANCING: ESTABLISHING THE PROVI- SIONS OF THE BONDING PACKAGE; ESTABLISHING VARIOUS REQUIREMENTS; DECLARING A POLICY STATEMENT; AND DE- CLARING AN EMERGENCY. Mr. Guerra moved for approval of the Ordinance on first reading rather than adoption on emergency and Mr. Farr seconded the motion. Frank Robbins advised the Council the major changes made to the Ordinance are increasing the fees and eliminating Exhibit "A". Mr. Farr stated he thinks the fees need to pay the expenses involved with the MUDs, be- cause they will remain tax-free for a long period of time when the Staff is required to spend a great deal of time with each MUD, and some of the MUDs may never materialize. Mr. Brown asked what the City had done to make the prior MUDs more equitable. Mr. Gonzalez stated the City had spent much more time than what was collected in fees, specifically $15,000.00. The City tried to collect $4,000.00 from each of the four MUDs. Mr. Robbins advised the City had received those funds from Highridge's two MUDs but not from Rivergate's two MUDs, and Mr. Gonzalez stated he hoped we would still be able to collect those charges when the projects get going. Mr. Robbins stated the four MUDs filed with the City have not yet filed with the State. Mr. Gonzalez stated for the record the City is not looking for what we can get from MUD applicants, but that the City is committing additional dollars for a study of a water shed, and that we need to be able to recoup some of our expenses involved in the MUD processes. The Council voted unani- mously for åpproval of the Ordinance on first reading. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A PROPOSED ELECTRIC POWER AGREEMENT BETWEEN SAID CITY AND SOUTHWEST TEXAS STATE UNIVERSITY: AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT AND ANY AND ALL OTHER DOCUMENTS INCIDENT THERETO: AND DECLARING AN EFFECTIVE DATE. Mr. Guerra moved for adoption of the Resolution and Ms. Kissler second- ed the motion (Mr. Coddington left for the remainder of the meeting). Mr. Farr moved to amend Section 2.04 of the Agreement to add the fol- lowing language at the end of that Section: "The City will set a reason- able wheeling or facilities use charge for the use of City facilities". Ms. Kissler seconded the motion, which passed unanimously. The Council then voted unanimously for adoption of the Resolution. Mayor Younger introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A PROPOSED AMENDED MEMORANDUM OF UNDERSTANDING BETWEEN SAID CITY AND THE LOWER COLORADO RIVER AUTHORITY: AUTHOR- IZING THE MAYOR TO EXECUTE THE MEMORANDUM: AND DECLARING AN EFFECTIVE DATE. Mr. Farr moved for adoption of the Resolution and Mayor Younger second- ed the motion, which passed unanimously.
