<br />37 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Special Meeting July 7,1986 Page 3 <br /> <br /> <br />FOR OUT-OF-DISTRICT SERVICE: ESTABLISHING A FEE FOR <br />REVIEW OF CREATION PETITIONS, COMPLETING CONSENT <br />AGREEMENTS, REVIEWING ENGINEERING AND LAND USE AND <br />TRANSPORTATION PLANS, IMPACT DISTRICTS WITHIN THE <br />CITY'S LIMITS AND ITS EXTRATERRITORIAL JURISDICTION: <br />ESTABLISHING BASIC QUALIFICATIONS FOR CONSENT TO THE <br />CREATION OF A UTILITY DISTRICT; PROVIDING PERCENTAGES <br />ALLOWED FOR BOND FINANCING: ESTABLISHING THE PROVI- <br />SIONS OF THE BONDING PACKAGE; ESTABLISHING VARIOUS <br />REQUIREMENTS; DECLARING A POLICY STATEMENT; AND DE- <br />CLARING AN EMERGENCY. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading rather <br />than adoption on emergency and Mr. Farr seconded the motion. Frank <br />Robbins advised the Council the major changes made to the Ordinance <br />are increasing the fees and eliminating Exhibit "A". Mr. Farr stated <br />he thinks the fees need to pay the expenses involved with the MUDs, be- <br />cause they will remain tax-free for a long period of time when the <br />Staff is required to spend a great deal of time with each MUD, and <br />some of the MUDs may never materialize. Mr. Brown asked what the <br />City had done to make the prior MUDs more equitable. Mr. Gonzalez <br />stated the City had spent much more time than what was collected in <br />fees, specifically $15,000.00. The City tried to collect $4,000.00 <br />from each of the four MUDs. Mr. Robbins advised the City had received <br />those funds from Highridge's two MUDs but not from Rivergate's two <br />MUDs, and Mr. Gonzalez stated he hoped we would still be able to collect <br />those charges when the projects get going. Mr. Robbins stated the four <br />MUDs filed with the City have not yet filed with the State. Mr. Gonzalez <br />stated for the record the City is not looking for what we can get from <br />MUD applicants, but that the City is committing additional dollars for <br />a study of a water shed, and that we need to be able to recoup some of <br />our expenses involved in the MUD processes. The Council voted unani- <br />mously for åpproval of the Ordinance on first reading. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />A PROPOSED ELECTRIC POWER AGREEMENT BETWEEN SAID CITY <br />AND SOUTHWEST TEXAS STATE UNIVERSITY: AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT AND ANY AND ALL OTHER <br />DOCUMENTS INCIDENT THERETO: AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Guerra moved for adoption of the Resolution and Ms. Kissler second- <br />ed the motion (Mr. Coddington left for the remainder of the meeting). <br />Mr. Farr moved to amend Section 2.04 of the Agreement to add the fol- <br />lowing language at the end of that Section: "The City will set a reason- <br />able wheeling or facilities use charge for the use of City facilities". <br />Ms. Kissler seconded the motion, which passed unanimously. The Council <br />then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />A PROPOSED AMENDED MEMORANDUM OF UNDERSTANDING BETWEEN <br />SAID CITY AND THE LOWER COLORADO RIVER AUTHORITY: AUTHOR- <br />IZING THE MAYOR TO EXECUTE THE MEMORANDUM: AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for adoption of the Resolution and Mayor Younger second- <br />ed the motion, which passed unanimously. <br />
