<br />26 <br /> <br />RESOLUTION 1986-l36R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF AN AGREEMENT FOR MUTUAL AID IN <br />FIRE PROTECTION BETWEEN SAID CITY AND THE <br />SOUTH HAYS COUNTY VOLUNTEER FIRE DEPARTMENT, <br />INC., AUTHORIZING THE MAYOR OF SAID CITY TO <br />EXECUTE SAID AGREEMENT, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, The State of Texas pursuant to Article 6228f, Texas <br />Revised Civil Statutes, has declared it to be the public policy of <br />the State to provide financial assistance to the surviving spouse <br />and minor children of paid firefighters when such paid <br />firefighters suffer violent death in the course of the performance <br />of their duties; and, <br /> <br />WHEREAS, the federal government, pursuant to 42 U.S.C.S. <br />Section 3796, provides for the payment of certain benefits to the <br />surviving spouse and/or children of public safety officers who <br />have died as a "proximate result of a personal injury sustained in <br />the line of duty"; and, <br /> <br />WHEREAS, insurance contracts entered into by some <br />firefighters and various pension systems provide for the payment <br />of death, disability and/or injury benefits when death or injury <br />occur "in the line of duty"; and, <br /> <br />WHEREAS, it is to the benefit of the firefighters of the City <br />of San Marcos to have clearly established that responding to or <br />working at a fire or other emergency outside said City's <br />jurisdictional area but within an area for which the City of San <br />Marcos has entered into an Agreement For Mutual Aid In Fire <br />Protection is work "in the line of duty" for City of San Marcos <br />firefighters; and, <br /> <br />WHEREAS, the City of San Marcos has the authority, pursuant <br />to its Charter and State law, to enter into agreements for the <br />provision of fire protection services; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of an Agreement For <br />Mutual Aid In Fire Protection between the City of San Marcos, <br />Texas, and the South Hays County Volunteer Fire Department, Inc., <br />a copy of which is attached hereto as Exhibit A and incorporated <br />herein for all intents and purposes, are hereby approved in all <br />respects. <br /> <br />PART 2. That the Mayor of the City of San Marcos Texas, <br />J.E. Younger, be, and he is hereby, authorized to execute said <br />Agreement on behalf of the City of San Marcos, Texas. <br /> <br />PART 3. That this Resolution shall <br />immediately from and after its passage. <br /> <br />become <br /> <br />effective <br /> <br />ADOPTED this <br /> <br />10 <br /> <br />day of <br /> <br />(\~ <br /> <br />'--. .
