<br />27 <br /> <br />STATE OF TEXAS <br /> <br />AGREEMENT FOR MUTUAL <br />FIRE PROTECTION <br /> <br />AID <br /> <br />IN <br /> <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br />This Agreement is made and entered into this ~ day of <br />17~~~ , A.D., 19~ by and between the City of San <br /> <br />Marcos, Texas, a municipal corporation organized and existing by <br /> <br />and under the laws of the State of Texas, acting through authority <br /> <br />conferred on its Mayor J.E. Younger, by Resolution duly adopted <br />on l1~lJ.VI ,/ {1 19-4:-, and the South Hays County Volunteer Fire <br /> <br />Department, <br /> <br />Inc., a fire department operating in a geographical <br /> <br />area of South Hays County Texas, duly incorporated and organized <br /> <br />under the laws of the State of Texas, acting through authority <br />conferred on its Board of Directors. <br /> <br />I. <br /> <br />The purpose of this Agreement is to secure to citizens of the <br />City of San Marcos" Texas and to citizens residing in the South <br /> <br />Hays County Rural Fire Prevention District Hays County, Texas <br /> <br />the benefits of mutual aid in firefighting and in the protection <br />of life and property from fire. <br /> <br />II. <br /> <br />In the event of a serious fire or fires, as determined by the <br /> <br />the <br /> <br />Volunteer <br /> <br />Fire <br /> <br />Chief, <br /> <br />or <br /> <br />in <br /> <br />his <br /> <br />absence, <br /> <br />the <br /> <br />Volunteer <br /> <br />Assistant Fire Chief, or the Volunteer Fire Captain, on duty, of <br /> <br />the South Hays County Volunteer Fire Department, Inc. within the <br /> <br />geographical area of the South Hays County Rural Fire Prevention <br /> <br />District; or in the event equipment of said fire department is <br />insufficient incapable or unavailable for any reason to fight a <br /> <br />fire or fires, as determined by <br /> <br />said personnel of the South Hays <br /> <br />County <br /> <br />Volunteer <br /> <br />Fire <br /> <br />Department <br /> <br />Inc. , <br /> <br />located <br /> <br />within <br /> <br />said <br /> <br />geographical area set forth hereinabove; or in both such events, <br /> <br />then, upon request to the Director of Police and Fire, Fire Chief <br /> <br />or, in their absence the Shift Captain, on duty, of the San Marcos <br /> <br />Fire Department by the above-designated personnel of the South <br /> <br />Hays <br /> <br />County <br /> <br />Volunteer <br /> <br />Fire <br /> <br />Department, <br /> <br />Inc. <br /> <br />firefighting <br /> <br />equipment, <br /> <br />if <br /> <br />available <br /> <br />and <br /> <br />in <br /> <br />good <br /> <br />working <br /> <br />order, <br /> <br />and <br /> <br />personnel, <br /> <br />if <br /> <br />available, <br /> <br />of <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />-1- <br />
