27 STATE OF TEXAS AGREEMENT FOR MUTUAL FIRE PROTECTION AID IN COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS: This Agreement is made and entered into this ~ day of 17~~~ , A.D., 19~ by and between the City of San Marcos, Texas, a municipal corporation organized and existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor J.E. Younger, by Resolution duly adopted on l1~lJ.VI ,/ {1 19-4:-, and the South Hays County Volunteer Fire Department, Inc., a fire department operating in a geographical area of South Hays County Texas, duly incorporated and organized under the laws of the State of Texas, acting through authority conferred on its Board of Directors. I. The purpose of this Agreement is to secure to citizens of the City of San Marcos" Texas and to citizens residing in the South Hays County Rural Fire Prevention District Hays County, Texas the benefits of mutual aid in firefighting and in the protection of life and property from fire. II. In the event of a serious fire or fires, as determined by the the Volunteer Fire Chief, or in his absence, the Volunteer Assistant Fire Chief, or the Volunteer Fire Captain, on duty, of the South Hays County Volunteer Fire Department, Inc. within the geographical area of the South Hays County Rural Fire Prevention District; or in the event equipment of said fire department is insufficient incapable or unavailable for any reason to fight a fire or fires, as determined by said personnel of the South Hays County Volunteer Fire Department Inc. , located within said geographical area set forth hereinabove; or in both such events, then, upon request to the Director of Police and Fire, Fire Chief or, in their absence the Shift Captain, on duty, of the San Marcos Fire Department by the above-designated personnel of the South Hays County Volunteer Fire Department, Inc. firefighting equipment, if available and in good working order, and personnel, if available, of the San Marcos -1-
