<br />ARTICLE 3 <br /> <br />REIMBURSABLE EXPENSES <br /> <br />3.1 <br /> <br />If reimbursable expenses are to be paid as <br /> <br />a <br /> <br />part <br /> <br />of <br /> <br />this <br /> <br />Agreement <br /> <br />as set forth in Article 12, such expenses are in addition to <br /> <br />the Compensation for Basic and Additional Services and <br /> <br />include <br /> <br />actual <br /> <br />expenditures <br /> <br />made <br /> <br />by <br /> <br />the <br /> <br />Engineer <br /> <br />and the Engineer's employees and <br /> <br />consultants in the interest of the Project for the expenses <br /> <br />listed <br /> <br />in <br /> <br />the following Subparagraph: <br /> <br />3.1.1 <br /> <br />Long <br /> <br />distance <br /> <br />phone <br /> <br />calls, copying expense other than that <br /> <br />included as a part of Basic Services <br /> <br />under <br /> <br />1. 3, <br /> <br />out-of-town <br /> <br />travel <br /> <br />expenses <br /> <br />including <br /> <br />mileage <br /> <br />and <br /> <br />a <br /> <br />per diem allowance as approved by <br /> <br />Owner, and any other expenses incurred at Owner's request. <br /> <br />ARTICLE 4 <br /> <br />PAYMENTS TO THE ENGINEER <br /> <br />4.1 <br /> <br />PAYMENTS ON ACCOUNT OF BASIC SERVICES <br /> <br />4.1.1 <br /> <br />Payments for Basic Services shall be made to Engineer <br /> <br />within <br /> <br />thirty <br /> <br />(30) <br /> <br />days <br /> <br />following <br /> <br />receipt <br /> <br />by <br /> <br />Owner of Engineer's invoice <br /> <br />therefor and shall be in proportion to services performed so <br /> <br />that <br /> <br />the <br /> <br />compensation <br /> <br />at <br /> <br />the <br /> <br />completion of each of the phases shall be on the <br /> <br />basis set forth in Article 12. <br /> <br />4.2 <br /> <br />PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES <br /> <br />4.2.1 <br /> <br />Payments on account of the Engineer's Additional Services <br /> <br />as <br /> <br />defined <br /> <br />in <br /> <br />Paragraph <br /> <br />1.6 and for Reimbursable Expenses as defined in <br /> <br />Article 3 shall be made monthly upon <br /> <br />presentation <br /> <br />of <br /> <br />the <br /> <br />Engineer's <br /> <br />statement of services rendered or expenses incurred. <br /> <br />4.3 <br /> <br />PROJECT(S) SUSPENSION OR TERMINATION <br /> <br />4.3.1 <br /> <br />If <br /> <br />the <br /> <br />project(s) <br /> <br />is suspended or abandoned in whole or in <br /> <br />part for more than six (6) months, the Engineer <br /> <br />shall <br /> <br />be <br /> <br />compensated <br /> <br />for <br /> <br />all services performed prior to receipt of written notice from the <br /> <br />Owner of such suspension or abandonment. <br /> <br />If <br /> <br />the project(s) <br /> <br />is <br /> <br />then <br /> <br />resumed <br /> <br />after <br /> <br />being <br /> <br />suspended <br /> <br />for <br /> <br />more <br /> <br />than <br /> <br />six <br /> <br />( 6) months, the <br /> <br />Engineer's compensation shall be subject to renegotiation. <br /> <br />ARTICLE 5 <br /> <br />ENGINEER'S ACCOUNTING RECORDS <br /> <br />5.1 <br /> <br />All expense records of Engineer shall be kept on a recognized <br /> <br />accounting basis acceptable to the Owner and shall be available to <br /> <br />the <br /> <br />-11- <br />
