<br />the Engineer and shall render responses pertaining thereto promptly and <br /> <br />provide <br /> <br />Engineer <br /> <br />with <br /> <br />requested <br /> <br />data <br /> <br />or <br /> <br />information <br /> <br />in <br /> <br />Owner's <br /> <br />possession relating to the project(s). <br /> <br />2.3 <br /> <br />The <br /> <br />Owner <br /> <br />shall <br /> <br />provide <br /> <br />access <br /> <br />to and make all necessary <br /> <br />provisions for the Engineer to enter upon public and <br /> <br />private <br /> <br />property <br /> <br />as <br /> <br />required <br /> <br />for <br /> <br />the <br /> <br />Engineer <br /> <br />to <br /> <br />perform <br /> <br />its <br /> <br />services under this <br /> <br />Agreement. <br />2.4 The Owner <br />chemical and other <br /> <br />shall <br /> <br />furnish <br /> <br />soils, <br /> <br />structural, <br /> <br />mechanical, <br /> <br />laboratory <br /> <br />tests, <br /> <br />inspections <br /> <br />and <br /> <br />reports <br /> <br />as <br /> <br />required by law or the construction contract documents or as reasonably <br /> <br />needed by the Engineer. <br /> <br />The Engineer shall not be held responsible for <br /> <br />its reliance on any such information supplied by <br /> <br />Owner <br /> <br />provided <br /> <br />that <br /> <br />Engineer <br /> <br />does not know or reasonably cannot be expected to know of any <br /> <br />deficiency or error in such information supplied by Owner. <br /> <br />2.5 <br /> <br />The Owner shall furnish all legal accounting <br /> <br />and <br /> <br />insurance <br /> <br />counseling services as may be necessary at any time for the project(s), <br /> <br />including <br /> <br />such auditing services as the Owner may require to ascertain <br /> <br />how or for what purposes the Contractor uses the money paid <br /> <br />by <br /> <br />or <br /> <br />on <br /> <br />behalf of the Owner. <br /> <br />2.6 <br /> <br />The Owner shall furnish required information and services and <br /> <br />shall <br /> <br />render <br /> <br />responses and conduct its review of written materials as <br /> <br />expeditiously as possible. <br /> <br />2.7 <br /> <br />The Owner shall pay all costs incident to obtaining <br /> <br />bids <br /> <br />or <br /> <br />proposals from contractors. <br /> <br />2.8 <br /> <br />The Owner shall either direct the Engineer to perform any and <br /> <br />all <br /> <br />Additional <br /> <br />Services necessary to complete the project(s) or shall <br /> <br />furnish such services itself. <br /> <br />2.9 <br /> <br />The Owner shall <br /> <br />pay <br /> <br />all <br /> <br />fees <br /> <br />for <br /> <br />filing <br /> <br />and <br /> <br />processing <br /> <br />permits in connection with the project(s). <br /> <br />2.10 <br /> <br />The Owner shall bear all costs incident to this Article. <br /> <br />2.11 <br /> <br />Owner <br /> <br />shall <br /> <br />provide <br /> <br />its standard construction construction <br /> <br />~ontract <br /> <br />documents <br /> <br />which <br /> <br />do <br /> <br />not <br /> <br />include <br /> <br />plans <br /> <br />or <br /> <br />technical <br /> <br />specifications, <br /> <br />to <br /> <br />the <br /> <br />Engineer <br /> <br />prior to commencement of the design <br /> <br />phase, Section 1.2. <br /> <br />2.12 <br /> <br />Owner shall provide the Engineer with <br /> <br />the <br /> <br />accounting <br /> <br />basis <br /> <br />for billing acceptable to the Owner. <br /> <br />-10- <br />
