<br />1.5.10 <br /> <br />The Engineer shall review and make <br /> <br />all <br /> <br />decisions <br /> <br />regarding <br /> <br />the <br /> <br />approval <br /> <br />or <br /> <br />taking <br /> <br />of <br /> <br />other <br /> <br />appropriate <br /> <br />action <br /> <br />upon <br /> <br />the <br /> <br />Contractor's submittals, including but not limited to, <br /> <br />Shop <br /> <br />Drawings, <br /> <br />Product <br /> <br />Data <br /> <br />and <br /> <br />Samples, <br /> <br />Schedule of Values and progress schedule. <br /> <br />Such action shall be taken with reasonable <br /> <br />promptness, <br /> <br />but <br /> <br />generally <br /> <br />not <br /> <br />to <br /> <br />exceed fifteen (IS) days or such period of time which will not <br /> <br />cause delay of the project(s). <br /> <br />1.5.11 <br /> <br />The Engineer shall prepare <br /> <br />Change <br /> <br />Orders <br /> <br />for <br /> <br />the <br /> <br />Owner's <br /> <br />approval <br /> <br />and <br /> <br />execution <br /> <br />in <br /> <br />accordance with the construction contract <br /> <br />documents, but shall not issue change orders not previously approved in <br /> <br />writing by Owner, and no course of conduct on the part of <br /> <br />Engineer <br /> <br />or <br /> <br />Owner shall act to amend, waive or alter this provision. <br /> <br />1.5.12 <br /> <br />The <br /> <br />Engineer <br /> <br />shall <br /> <br />conduct <br /> <br />professional <br /> <br />inspections <br /> <br />to <br /> <br />determine the Dates of Substantial Completion and final completion, <br /> <br />to <br /> <br />evaluate <br /> <br />the <br /> <br />Work <br /> <br />for <br /> <br />acceptable <br /> <br />conformance with the construction <br /> <br />contract documents and in light of any subsequent <br /> <br />tests <br /> <br />performed <br /> <br />as <br /> <br />described <br /> <br />in Section 1.5.8 hereof, to verify that any minor deviations <br /> <br />from the construction contract documents as described in Section <br /> <br />1.5.8 <br /> <br />hereof <br /> <br />have <br /> <br />been <br /> <br />corrected <br /> <br />and <br /> <br />that <br /> <br />the <br /> <br />reasons for any specific <br /> <br />qualifications in any and all <br /> <br />previous <br /> <br />Certificates <br /> <br />For <br /> <br />Payment <br /> <br />as <br /> <br />described <br /> <br />in <br /> <br />Section <br /> <br />1.5.8 <br /> <br />hereof are either no longer valid or the <br /> <br />condition(s) and/or problem(s) have been corrected; shall <br /> <br />receive <br /> <br />and <br /> <br />review <br /> <br />written <br /> <br />warranties <br /> <br />and <br /> <br />related <br /> <br />documents <br /> <br />required <br /> <br />by <br /> <br />the <br /> <br />construction contract documents and assembled by the Contractor; <br /> <br />shall <br /> <br />issue a final Certificate for Payment or take other appropriate action; <br /> <br />and <br /> <br />shall <br /> <br />make a recommendation to Owner regarding Owner's acceptance <br /> <br />of the Project. <br /> <br />1.5.13 <br /> <br />The extent of the duties, responsibilities and limitations of <br /> <br />authority <br /> <br />of <br /> <br />the <br /> <br />Engineer <br /> <br />as <br /> <br />the <br /> <br />Owner's <br /> <br />representative <br /> <br />during <br /> <br />construction <br /> <br />shall <br /> <br />not be modified or extended after the construction <br /> <br />contract documents have been authorized to be competitively bid without <br /> <br />written consent of the Owner and the Engineer and with <br /> <br />notice <br /> <br />to <br /> <br />the <br /> <br />Contractor. <br /> <br />1.5.14 <br /> <br />The <br /> <br />Engineer <br /> <br />shall prepare and submit to the Owner a set of <br /> <br />reproducible <br /> <br />mylar <br /> <br />record <br /> <br />drawings <br /> <br />as <br /> <br />documented <br /> <br />by <br /> <br />the <br /> <br />Owner's <br /> <br />inspector <br /> <br />and provided to the Engineer, showing significant changes in <br /> <br />the Work made during the construction phase. <br /> <br />-7- <br />
