<br />1.5.15 <br /> <br />In the event of any arbitration proceeding as provided in the <br /> <br />construction contract documents, the <br /> <br />Engineer <br /> <br />may <br /> <br />be <br /> <br />made <br /> <br />a <br /> <br />party <br /> <br />thereto at the request of either Owner or Contractor. <br /> <br />1.6 <br /> <br />ADDITIONAL SERVICES <br /> <br />For <br /> <br />the <br /> <br />purposes <br /> <br />of <br /> <br />this Contract, additional services will be <br /> <br />considered to be all services not included in the basic contracted <br /> <br />services as identified in Article 1, excluding <br /> <br />Sections <br /> <br />1.6 <br /> <br />and <br /> <br />1.7. <br /> <br />Additional <br /> <br />services <br /> <br />shall <br /> <br />be <br /> <br />provided <br /> <br />if authorized or <br /> <br />confirmed in writing by the Owner as provided in <br /> <br />this <br /> <br />agreement, <br /> <br />and <br /> <br />compensation shall be in addition to that specified for basic <br /> <br />services. <br /> <br />Compensation <br /> <br />for <br /> <br />additional <br /> <br />services <br /> <br />shall <br /> <br />be <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />Section <br /> <br />12.2.1 <br /> <br />of <br /> <br />this <br /> <br />contract. <br /> <br />Additional <br /> <br />services shall <br /> <br />include <br /> <br />but <br /> <br />not <br /> <br />be <br /> <br />limited <br /> <br />to <br /> <br />the <br /> <br />following <br /> <br />potential work items. <br /> <br />1.6.1 <br /> <br />Making <br /> <br />revisions in Plans, Specifications or other documents <br /> <br />when <br /> <br />such <br /> <br />revisions <br /> <br />are <br /> <br />inconsistent <br /> <br />with <br /> <br />written <br /> <br />approvals <br /> <br />or <br /> <br />instructions <br /> <br />previously <br /> <br />given <br /> <br />or <br /> <br />are due to other causes not solely <br /> <br />within the control of the Engineer. <br /> <br />1.6.2 <br /> <br />Additional copies of Contract Drawings, <br /> <br />Specifications, <br /> <br />and <br /> <br />other <br /> <br />construction contract documents other than those provided for in <br /> <br />paragraph 1.3.1 hereof as a part of Basic Services. <br /> <br />1.6.3 <br /> <br />Prepare <br /> <br />application{s) <br /> <br />for <br /> <br />all <br /> <br />governmental <br /> <br />authorities <br /> <br />having jurisdiction over the project. <br /> <br />1.6.4 <br /> <br />Preparation and issuance of Addenda made necessary by Owner's <br /> <br />requested <br /> <br />changes or modifications which are inconsistent with written <br /> <br />approvals or instructions previously given or are due to <br /> <br />other <br /> <br />causes <br /> <br />not solely within Engineer's control. <br /> <br />1.6.5 <br /> <br />Services of a Resident Project Representative. <br /> <br />1.6.6 <br /> <br />Appearances <br /> <br />before <br /> <br />regulatory <br /> <br />agencies outside the City of <br /> <br />San Marcos, Texas. <br /> <br />1.6.7 <br /> <br />Assistance <br /> <br />to <br /> <br />the <br /> <br />Owner <br /> <br />as <br /> <br />an <br /> <br />expert <br /> <br />witness <br /> <br />in <br /> <br />any <br /> <br />litigation <br /> <br />with <br /> <br />third <br /> <br />parties, <br /> <br />arising <br /> <br />from <br /> <br />the <br /> <br />development <br /> <br />or <br /> <br />construction of the Project, including preparation of engineering <br /> <br />data <br /> <br />and reports. <br /> <br />-8- <br />
