<br />59 <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting July 14, 1986 Page 15 <br /> <br /> <br />Mr. Coddington moved for adoption of the Resolution and Ms. Kissler <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />thE:: caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />r1ARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />A PROPOSED CONTRACT BETWEEN SAID CITY AND JONES AND <br />NEUSE, INC. AND ASSOCIATES, FOR THE PROVISION TO SAID <br />CITY OF ENGINEERING AND PLANNING SERVICES TO DEVELOP A <br />WATER AND WASTEWATER PLAN FOR THE COTTONWOOD CREEK SEWER <br />SHED; AUTHORIZING THE MAYOR TO EXECUTE SAID CONTRACT <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Farr moved for adoption of the Resolution and Mr. Brown seconded <br />the motion. Mayor Younger stated to Mr. Neuse that certain fees and <br />costs were a part of this agreement, such as population growth figures, <br />which were information the City has available. Mr. Neuse stated they <br />intend to make maximum utilization of any work that has already been <br />done to date. Mr. Neuse stated in regard to population projections, <br />it is his understanding that the development of the scope and cost pro- <br />posal of this contract take into consideration that some of the informa- <br />tion is available, and that there are descriptions for the development <br />of the information to bring it to where they need to go forward. He <br />stated this is a cost reimbursement type contract whère the City will <br />only be billed for the amount of effort it takes their company to do <br />the work and that they intend to make full utilization of what is avail- <br />able. He stated if population projections are available to a greater <br />extent than what they have assumed, it will reflect in the billings to <br />the City. He stated they would like to have the opportunity to review <br />what information is available and did not mean to imply in the contract <br />that they intended to completely redo work that has already been done <br />and will work with the Staff as much as possible to prevent that from <br />occurring. Mr. Gonzalez pointed out to the Council that the scope of <br />the Cottonwood Creek Planning Area is beyond the Master Plan Area and <br />goes considerably off the map~ we have and beyond all the population <br />work we now have. The Council voted unanimously for adoption of the <br />Resolution. <br /> <br />Mayor Younger introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF <br />PROPOSED AGREEMENTS ~~ITH CPS BUSINESS SYSTEMS, INC. <br />FOR THE PROVISION TO SAID CITY OF CERTAIN HARDWARE <br />AND SOFTWARE AND THE MAINTENANCE THEREOF; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE SAID AGREEMENTS ON BEHALF <br />OF SAID CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Coddington moved for adoption of the Resolution and Mayor Younger <br />seconded the motion. A CPS representative advised the Council another <br />vendor would cause problems, as they were the sole source to CAD. CPS <br />stated they are installing hardware and software and providing service <br />for the equipment going in at the Appraisal District. CPS stated they <br />are the sole source vendor of the Appraisal District, in that no other <br />vendor is involved. CPS has talked with the Attorney General's Office, <br />and because they are providing everything for the system, they are con- <br />sidered the sole source. CPS agreed with Mr. Coddington the hardware <br />could be purchased elsewhere, but that in order to make that hardware <br />at CAD work under CPS' software, CPS is the sole source. The CAD will <br />be licensed with CPS' software and the City will be licensed the software <br />
