<br /> <br /> <br /> <br /> <br />rtD <br />N <br /> <br /> <br />52 <br /> <br />ORDINANCE 1986-139 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, M1ENDING <br />SECTIONS 31 AND 33 OF THAT ORDINANCE <br />ADOPTED ON SEPTEMBER 8, 1986, WHICH <br />AMENDED THE GENERAL ZONING ORDINANCE, TO <br />DELETE ALL REFERENCES TO AND PROVISIONS <br />IN SAID SECTION PERTAINING TO SECTION <br />36(H)(1) OF THE GENERAL ZONING ORDINANCE <br />OF THE CODE OF ORDINANCES OF SAID CITY <br />AND TO AMEND SECTION 36(H)(1) OF SAID <br />GENERAL ZONING ORDINANCE PROVIDING FOR <br />PROJECTIONS OF ROOF OVERHANGS AS <br />EXCEPTIONS TO THE MINIMUM SETBACK <br />REQUIREMENTS, AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 31 of that Ordinance adopted <br />September 8, 1986, which made several amendments to the General <br />Zoning Ordinance of the Code of Ordinances of said City, is hereby <br />amended to read as follows: <br /> <br />"SECTION 31. That Section 36, Area Requirements, <br />of the General Zoning Ordinance of the San Marcos Code <br />of Ordinances is hereby renamed 36, Supplemental Area <br />Requirements." <br /> <br />SECTION 2. That Section 33 of that Ordinance adopted <br />September 8, 1986 and referred to in Section 1 hereof is hereby <br />amended to read as follows: <br /> <br />"SECTION 33. That new Subsection 36(H) of the <br />General Zoning Ordinance of the San Marcos Code of <br />Ordinances is adopted to read as follows: <br /> <br />I(H) ... <br /> <br />( 1) <br /> <br />Projections of roof overhangs including <br />cornices, eaves, gutters, and downspouts, <br />shade control devices, and awnings or canopies <br />over doors and windows, may project a distance <br />not exceeding three feet into the required <br />yard provided, however, that such projection <br />shall extend no closer than five feet to any <br />lot line except as permitted below: <br /> <br />(a) <br /> <br />such projections in the R-2 and <br />district shall extend no closer <br />three feet to any lot line~ <br /> <br />DP-2 <br />than <br /> <br />(b) <br /> <br />such projections in the PDD and ZL-l <br />district may extend a maximum of two feet <br />over the lot line into the required <br />five-foot maintenance and drainage <br />easement on the adjacent lot~ and <br /> <br />(c) <br /> <br />such projections in the PUD districts may <br />extend as authorized on the approved <br />Development Plan. <br /> <br />( 2) <br /> <br />Bay windows, balconies, and chimneys may <br />project a distance not exceeding two feet into <br />required yards, provided that such features do <br />not occupy, in total, more than one-third of <br />the length of the building wall on which they <br />are located. <br />
